RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE CONVEYANCE OF THE EL GRANADA QUARRY PARK PROPERTY FROM THE JOINT POWERS AGENCY FOR THE ACQUISITION, DEVELOPMENT AND OPERATION

OF THE EL GRANADA QUARRY PARK AND AUTHORIZING AND DIRECTING THE COUNTY MANAGER TO TAKE SUCH ACTIONS AS ARE NECESSARY TO TERMINATE THE LEASE WITH MIDCOAST PARKLANDS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Joint Powers Agency owns a certain forty (40) acre parcel of land, situated adjacent to the unincorporated community of El Granada, known as the El Granada Quarry Park property (“the Property”), which Property is subject to a lease with MidCoast Park Lands (“MPL”) entered into on August 17, 1999 (the “Lease”); and

 

WHEREAS, MPL has provided many contributed hours and improvements to Quarry Park over the past decade, and will continue to provide support and community outreach as a “Friends of” group; and

 

WHEREAS, by Grant Deed dated November 7, 1995, and recorded as Document No. 95-121942 in the Office Records of the San Mateo County Recorder, the County conveyed the property to the Joint Powers Agency for the Acquisition, Development and Operation of the El Granada Quarry Park (“Joint Powers Agency”); and

 

WHEREAS, the Governing Board of the Joint Powers Agency has approved a resolution reconveying the Property to the County; and

 

WHEREAS, this Board desires to accept the conveyance of the Property from the Joint Powers Agency, and to terminate the Lease.

 

NOW THEREFORE, THE BOARD OF SUPERVISORS RESOLVES AND ORDERS that the transfer of the El Granada Quarry Park property from the Joint Powers Agency to the County is hereby accepted, and the President of the Board is hereby authorized and directed to execute a certificate of acceptance, and other documents as may be required to complete the conveyance.

 

IT IS FURTHER RESOLVED AND ORDERED that the County Manager is hereby authorized and directed to take such actions as are necessary to terminate the Lease with MPL, including the execution of any and all documents necessary to terminate the Lease.
