RESOLUTION AUTHORIZING THE COUNTY MANAGER TO GIVE WRITTEN NOTICE TERMINATING THE JOINT EXERCISE OF POWERS AGREEMENT FOR THE ACQUISITION, DEVELOPMENT AND OPERATION OF A PARK ON PROPERTY COMMONLY KNOWN AS THE EL GRANADA QUARRY PARK PROPERTY

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County has entered into a certain agreement entitled “Joint Exercise of Powers Agreement for the Acquisition, Development and Operation of a Park on Property Commonly Known as the El Granada Quarry Park Property,” dated October 17, 1995 (“JPA Agreement”); and

WHEREAS, County desires to terminate such JPA Agreement; and

WHEREAS, section 2 of the JPA Agreement provides that either party can give notice of termination of the agreement no later than 90 days prior to the anniversary date upon which the JPA Agreement will be deemed terminated.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that notice shall be given terminating the JPA Agreement effective on October 17, 2009, and the County Manager is hereby authorized and directed to expeditiously give such notice and to take such additional actions as may be necessary to terminate the JPA Agreement.
