RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN AMENDED MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF SAN MATEO AND THE FRIENDS OF HUDDART AND WUNDERLICH PARKS REGARDING RENOVATION AND OPERATION OF THE FOLGER STABLE BUILDING AND AUTHORIZING THE COUNTY MANAGER TO EXECUTE THE POSSESSION AND USE AGREEMENT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County of San Mateo (County) and the Friends of Huddart and Wunderlich Parks (Friends) documented and memorialized their mutual intent to cooperatively work to oversee completion of the Folger Stable restoration and implementation of ongoing public and equestrian programs at the Folger Estate Stable through entering into a Memorandum of Understanding (MOU) on February 28, 2006; and

WHEREAS, the County and the Friends desire to amend their 2006 MOU to allow for a change in responsibilities for conducting the renovation of the Stable Building; and

WHEREAS, under the proposed Amended MOU, the Friends will assume liability and operational management for the actual renovation including the contracting of design and construction services; and

WHEREAS, under the proposed Amended MOU, the County will have final oversight and approval of all plans prior to implementation and will not be responsible for costs of the renovation, bidding the contracts or daily administration of the renovation; and

WHEREAS, the County and the Friends mutually desire to enter into the Amended Memorandum of Understanding regarding renovation and operation of the Folger Stable Building.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors authorizes the President of the Board to execute an Amended Memorandum of Understanding between the County of San Mateo and the Friends of Huddart and Wunderlich Parks regarding renovation and operation of the Folger Stable Building and further authorizes the County Manager to execute the Possession and Use Agreement between the Friends of Huddart/Wunderlich Parks and the County.
