BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION: 1. ADOPTING PLANS AND SPECIFICATIONS, INCLUDING CONFORMANCE WITH PREVAILING WAGE SCALE REQUIREMENTS FOR COUNTY OFFICE BUILDING ELEVATOR MODERNIZATION, 455 COUNTY CENTER, REDWOOD CITY, CALIFORNIA (PROJECT NO. P11P1); AND
2. AWARDING AND AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE A CONTRACT WITH ASCENT ELEVATOR SERVICES INC. IN THE AMOUNT OF $248,000 FOR THE ABOVE REFERENCED PROJECT; AND
3. AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE CONTRACT REVISION ORDERS RELATED TO THE PROJECT UP TO A MAXIMUM OF $40,000.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on July 22, 2008, adopt Resolution No. 069602, which resolution rejected all bids received on May 13, 2008, for the County Office Building Elevator Modernization and authorized the Director of Public Works to re-advertise the same work and issue a call for sealed bids; and

WHEREAS, amended plans and specifications, dated July 25, 2008, were prepared and approved by the Director of Public Works for the County Office Building Elevator Modernization, and said plans and specifications were filed in the office of the Director of Public Works; and

WHEREAS, the plans and specifications require that the contractors performing the work pay not less than the general prevailing rates of wages, as established by the Department of Industrial Relations, in the locality in which said work is to be performed for each type of workman needed to execute the contract; and

WHEREAS, the Clerk of this Board did, in public on September 9, 2008, open and examine all sealed bids; and

WHEREAS, this Board of Supervisors has caused an analysis of said bids to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said bids and the analysis thereof; and

WHEREAS, the lowest responsible bid was submitted by Ascent Elevator Services Inc. in the amount of Two Hundred Forty-Eight Thousand and 00/100 Dollars ($248,000.00) based on an estimate of the amount of work to be done.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that

1.

The plans and specifications are hereby approved and adopted as the plans and specifications to be adhered to in letting and performing the work under a contract for the improvements described therein.

2.

It is in the best interest of the County of San Mateo to award the contract for the County Office Building Modernization to:

Ascent Elevator Services Inc.

San Francisco, CA 94124

The County of San Mateo shall enter into a written contract with Ascent Elevator Services for completion of said work as required by the plans and specifications, as hereinbefore mentioned.

The President of this Board of Supervisors is hereby authorized and directed to execute a written contract with Ascent Elevator Services in the amount of $248,000.00 for completion of said work as hereinbefore mentioned and to receive and approve the Faithful Performance Surety Bond (“Performance Bond”) and the Labor and Material Surety Bond (“Payment Bond”) required to be posted by the said Contractor with the County of San Mateo in connection therewith.

The Director of Public Works is hereby authorized to execute contract revision orders related to the said work not exceeding $40,000.00 in aggregate, which includes Additive Alternate Bid No. 1 and Additive Alternate Bid No. 2 plus a ten percent (10%) contingency to pay for added work resulting from unforeseen conditions not anticipated in the construction contract documents.

All payments to the Contractor shall be in accordance with the plans and specifications and authorized contract revision orders. Aggregate payment to the Contractor shall not exceed Two Hundred Eighty-Eight Thousand and No/100 Dollars ($288,000.00) without this Board’s approval.

7.

The Clerk of the Board of Supervisors, County of San of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
