ADOPT A RESOLUTION: 1) WAIVING THE REQUEST FOR PROPOSAL PROCESS REQUIREMENT FOR THE PROVISION OF COUNSELING SERVICES AND LITERACY AND NUMERACY INSTRUCTION AND LEARNING SERVICES FOR COURT AND COMMUNITY SCHOOLS STUDENTS; 2) AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN AGREEMENT WITH THE SAN MATEO COUNTY OFFICE OF EDUCATION TO PROVIDE COUNSELING SERVICES, AND LITERACY AND NUMERACY INSTRUCTION AND LEARNING SERVICES FOR COURT AND COMMUNITY SCHOOLS STUDENTS FOR THE TERM JULY 1, 2006 THROUGH JUNE 30, 2009, FOR A MAXIMUM OBLIGATION OF $768,527

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Ordinance Code Section 2.92.050 authorizes the Board of Supervisors to waive the Request for Proposals process in any situation where the Board determines that the best interest of the County would be served without the necessity of formal proposals; and

WHEREAS this Board has been asked to waive the Request for Proposal process requirements in order for Probation to contract with this qualified provider ; and

WHEREAS, this Board has determined that it is in the best interest of the County to waive the request for proposal process; and

WHEREAS, the JJCPA Juvenile Justice Coordinating Council has authorized funding to maintain the existing programs; and

WHEREAS, both parties wish to enter into an Agreement, whereby San Mateo County Office of Education shall provide counseling services and literacy and numeracy instruction and learning services for Court and Community Schools students for the period of July 1, 2006 through June 30, 2009; and

WHEREAS, this Board has been presented with the Agreement and has approved it as to both form and content and desires to enter into the Agreement:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the County requirement for the Request for Proposal process for said Agreement is hereby waived; and

BE IT RESOLVED that the Board of Supervisors authorizes the President of the Board of Supervisors be, and is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signatures thereto.
