(ACTING AS THE GOVERNING BOARD OF THE FAIR OAKS SEWER MAINTENANCE DISTRICT)

RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE
1) AN AMENDMENT TO AN AGREEMENT FOR TRANSMISSION OF SANITARY SEWAGE BY AND BETWEEN THE FAIR OAKS SEWER MAINTENANCE DISTRICT (DISTRICT) AND THE TOWN OF WOODSIDE (TOWN)
AND
2) AN AMENDMENT TO AN AGREEMENT FOR SANITARY SEWERAGE TREATMENT CAPACITY RIGHTS AND SERVICES BY AND BETWEEN THE DISTRICT, THE TOWN, AND THE CITY OF REDWOOD CITY
IN ORDER TO ALLOW NINE SPECIFIC PARCELS WITHIN THE TOWN TO BE PROVIDED FUTURE SEWER SERVICE BY GRAVITY INTO THE DISTRICT’S FACILITIES SUBJECT TO CERTAIN DETERMINATIONS THAT MUST BE MADE BY THE TOWN ENGINEER AND THE TOWN COUNCIL

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the Governing Board of the Fair Oaks Sewer Maintenance District (District), that

 

WHEREAS, nine parcels located in Town of Woodside (Town) and identified as APN’s 073-132-160, 073-132-200, 073-132-210, 073-132-240, 073-132-250, 073-133-210, 073-133-270, 073-133-280 and 073-133-340 have failed or may have failing septic systems that will present a potential public health hazard; and

 

WHEREAS, the Woodside Town Council passed Resolution Nos. 2008-6704 and 2008-6705 which granted sewer allocations to said properties and authorized execution of amendments to agreements with the City of Redwood City and the District; and

 

WHEREAS, it is necessary to amend the agreements approved by this Board on August 7, 2001 by Resolution Nos. 64668 and 64669, that provide for the transmission of sanitary sewage from the Town and the treatment thereof, in order for said properties, as identified above to be eligible to connect to the District facilities through a gravity system; and

 

WHEREAS, there has been presented to this Board, forms of amendments to said agreements, which have been appropriately executed by the Town and the City of Redwood City; and

 

WHEREAS, the Director of Public Works has recommended that the President of this Board be authorized to execute said amendments; and

 

WHEREAS, this Board has considered and concurs with the recommendation of the Director of Public Works.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

1.

the President of this Board of Supervisors be, and is hereby, authorized and directed to execute:

 
 

a.

the amendment entitled “Fifth Amendment to the Agreement for Transmission of Sanitary Sewage by and between the Fair Oaks Sewer Maintenance District and the Town of Woodside;” and

   
 

b.

the amendment entitled “Fifth Amendment to Sanitary Sewage Treatment Capacity Rights and Services”

 

2.

The Clerk of the Board of Supervisors be, and is hereby authorized and directed to attest to the signature of the President to said amendments.
