RESOLUTION WAIVING THE REQUIREMENT FOR A REQUEST FOR PROPOSAL PROCESS AND AUTHORIZING AND DIRECTING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN AGREEMENT WITH JONES AND STOKES TO RUN FROM THE DATE OF EXECUTION THROUGH FEBRUARY 28, 2010 IN AN AMOUNT NOT TO EXCEED $118,209 FOR THE PREPARATION OF AN INITIAL STUDY/ENVIRONMENTAL ASSESSMENT TO DETERMINE THE MOST APPROPRIATE LEVEL OF CEQA/NEPA ENVIRONMENTAL REVIEW, AND IF DETERMINED APPROPRIATE, FOR THE PREPARATION OF A MITIGATED NEGATIVE DECLARATION/ENVIRONMENTAL ASSESSMENT FOR AN AMENDMENT TO THE SAN BRUNO MOUNTAIN HABITAT CONSERVATION PLAN

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County of San Mateo, and the cities of Brisbane, Daly City, and South San Francisco (collectively, the “cities”) are parties to the San Bruno Mountain Habitat Conservation Plan (“HCP”), and the Agreement with Respect to the San Bruno Mountain Habitat Conservation Plan (“HCP Agreement”), recorded in the official records of San Mateo County as Document No 83026343, and are permittees under Permit No. PRT 2-9818 (“Section 10A Permit”), issued by the United States Fish and Wildlife Service (“USFWS” or Service”) under Section 10a of the Federal Endangered Species Act, 16 U.S.C section 1531 et seq.; and

WHEREAS, section IX of the HCP Agreement provides a process by which the HCP may be amended; and

 

WHEREAS, in December 2003, the County entered into a contract with Jones and Stokes for the purpose of preparing an Environmental Impact Report/Environmental Impact Study (“EIR/EIS”) for amendments to the HCP; and

 

WHEREAS, on July 17, 2006, the County reentered into a contract with Jones and Stokes for the purposes of preparing an expanded EIR/EIS for amendments to the HCP; and

 

WHEREAS, it is necessary and desirable that a new agreement with Jones and Stokes be entered into for the purpose of performing additional services necessary to complete an Initial Study/Environmental Assessment, and if determined appropriate, a Mitigated Negative Declaration/Environmental Assessment for amendments to the HCP; and

 

WHEREAS, it is in the County’s best interest to waive the requirement for a request for proposal process for the purpose of entering into an agreement with Jones and Stokes.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the requirement for a request for proposal process is hereby waived, and the President of this Board of Supervisors is hereby authorized and directed to execute an agreement with Jones and Stokes to run from the date of execution through February 28, 2010 in an amount not to exceed $118,209 for the preparation of an Initial Study/Environmental Assessment to determine the most appropriate level of CEQA/NEPA environmental review, and if determined appropriate, for the preparation of a Mitigated Negative Declaration/Environmental Assessment for an amendment to the San Bruno Mountain Habitat Conservation Plan.
