SUBJECT:

Certification of Voting Results from the November 4, 2008 Presidential General Election

 

RECOMMENDATION:

Adopt a resolution accepting the certificate of the Chief Elections Officer as the statement of the vote as determined by the official canvass of the consolidated November 4, 2008 Presidential General Election, and declaring certain candidates to be elected or appointed in lieu of holding an election, and declaring the results of certain ballot measures.

Accepting the certified statement of the official canvass of the votes cast by San Mateo County’s voters will endorse and give effect to the democratic process by which county residents have expressed their preferences for the decision makers and policies that will guide the direction of federal, state and local governments.

 

BACKGROUND:

On September 30, 2008 (Resolution No. 69706), this Honorable Board authorized the County’s Chief Elections Officer to conduct the November 4, 2008 Presidential General Election, in consolidation with certain local elections, as requested by local jurisdictions and in accordance with service agreements whereby the County would be reimbursed for related costs.

 

State law authorizes and directs the County’s Chief Elections Officer to complete, within the 28 days following the election, the canvass of all the ballots and votes cast in said election, including their reconciliation, inspection, processing, and counting, and to prepare a certified statement of the results and submit it to this Honorable Board for acceptance. A copy of that statement shall also be submitted to the California Secretary of State and to the chairperson of the county central committee of each political party. This Honorable Board of Supervisors, by acceptance of this statement authorizes and directs the governing body of each jurisdiction participating in the election to declare for contests under its jurisdiction the candidates elected or appointed in lieu of holding an election and the results for each ballot measure. DISCUSSION:

The Chief Elections Officer has duly completed the canvass of the vote and has duly prepared, certified, and submitted the official Statement of the Vote, as required. Additional copies are available upon request.

 

In addition to declaring the results for candidates and measures which appeared on the ballot for this election, the proposed Resolution also declares elected several Superior Court judges, whose names, in accordance with law, did not appear as candidates on the ballot in last June’s primary election because they were unopposed incumbents (see Elections Code § 8203).

 

This resolution has been reviewed and approved by County Counsel.

 

FISCAL IMPACT:

There is no fiscal impact.
