RESOLUTION WAIVING THE REQUEST FOR PROPOSAL PROCESS AND AUTHORIZING THE COUNTY PURCHASING AGENT TO ISSUE PURCHASE ORDERS TO INTERNATIONAL BUSINESS MACHINES (IBM) TO PROVIDE PROPRIETARY SOFTWARE LICENSES AND MAINTENANCE, HARDWARE MAINTENANCE, AND SUPPORT FOR THE TERM OF DECEMBER 16, 2008, TO DECEMBER 31, 2009, WITH A TOTAL FISCAL OBLIGATION NOT TO EXCEED $500,000.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, since 2006 International Business Machines (IBM) has acquired several companies with which the County has had a business relationship, including FileNet, Princeton Softech, CIMS Lab, and Cognos, and because the County’s Information Services Department uses applications and platforms from these companies to provide services to County residents, the County wishes to enter into purchase order with IBM to continue licensing and the provision of support for those applications and platforms;

WHEREAS, this Board has determined it to be in the best interest of the County to authorize the waiver of the Request for Proposal process since IBM is the only vendor able to provide licensure and support for the IBM software and hardware;

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a request to authorize the County Purchasing Agent to issue purchase orders to IBM in an amount not to exceed $500,000 to provide proprietary software licenses and maintenance, hardware maintenance, and support for the term of December 16, 2008, to December 31, 2009, in relation to those applications and platforms;

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Request for Proposal process is waived, the County Purchasing Agent is authorized to issue purchase orders to IBM in an amount not to exceed $500,000, the President of the Board of Supervisors is authorized and directed to execute said Resolution as is approved by the County Counsel for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.
