RESOLUTION 1. AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE A CONTRACT WITH ROCKAWAY CONSTRUCTION INC. IN THE AMOUNT OF $236,800.00 (BASE BID $178,500 + ALTERNATE NO. 1 $58,300) FOR THE ACCESSIBILITY IMPROVEMENTS TO THE 2^nd, 3^rd, 4^th, AND 5^th FLOOR TOILET ROOMS AT 455 COUNTY CENTER, REDWOOD CITY 2. AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE CONTRACT REVISION ORDERS RELATED TO THE ACCESSIBILITY IMPROVEMENTS NOT EXCEEDING $35,520.00 IN AGGREGATE, WHICH IS 15% OF THE CONTRACT AMOUNT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the Board of Supervisors did, on October 21, 2008, adopt Resolution No. 069757, which Resolution adopted and approved the plans and specifications, determined prevailing wage scales and called for sealed bids for the Accessibility Improvements, 2^nd, 4^th and 5^th Floor Toilet Rooms, and

WHEREAS, the clerk of this Board of Supervisors did, in public on November 18, 2008 open and examine all sealed proposals: and

WHEREAS, the Board of Supervisors has caused an analysis of said sealed proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said proposals and the analysis thereof; and

WHEREAS, Rockaway Construction, Inc. submitted the lowest responsible bid, in the amount of One Hundred Seventy-Eight Thousand Five Hundred and No/100 Dollars ($178,500.00) based on the estimate of the amount of the work to be done.

WHEREAS, Rockaway Construction, Inc. also submitted a bid for add alternate no.1 in the amount of Fifty-eight thousand three hundred ($58,300) to improve the toilets on the third floor based on the estimate of the amount of the work to be done.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

It is in the best interest of the County of San Mateo to award the contract for the Accessibility Improvements, 2^nd, 3^rd, 4^th and 5^th Floor Toilet Rooms to:

Rockaway Construction, Inc.

The County of San Mateo shall enter into a written contract with Rockaway Construction, Inc for the doing of said work as required by the plans and specifications adopted and approved by this Board of Supervisors, as hereinbefore mentioned.

The President of this Board of Supervisors shall be, and is hereby, authorized and directed, for and on behalf of the County of San Mateo, to enter into said written contract with Rockaway Construction, Inc for the doing of said work, as hereinbefore mentioned and to receive and approve the Faithful Performance Surety Bond and the Labor and Material Surety Bond required to be posted by the said Contractor with the County of San Mateo in connection therewith.

All payments to the Contractor shall be in accordance with the plans, specifications, and other contract documents. Aggregate payment to Contractor shall not exceed the sum of Two Hundred Thirty-Six Thousand, Eight Hundred and No/100 Dollars ($236,800.00) as may be amended by authorized revision orders without this Board’s approval.

5.

The Director of Public Works shall be and is hereby authorized to execute contract revision orders related to the Receiving Home Project not exceeding $35,520 in aggregate, which is 15% of the contract amount.

6.

The Clerk of the Board of Supervisors, County of San Mateo, shall be, and is hereby, authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
