RESOLUTION CALLING SPECIAL ELECTION TO FILL VACANCY ON THE BOARD OF SUPERVISORS FOR THE SECOND DISTRICT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, Supervisor Jerry Hill, upon his election to the State Legislature, has resigned from the office of Supervisor of the Second District effective November 30, 2008; and;

 

WHEREAS, Article II, Section 203 of the San Mateo County Charter provides that if a vacancy occurs on the Board of Supervisors, the Board may, within 30 days of the effective date of the vacancy, call a special election to fill the vacancy; and;

 

WHEREAS, Section 203 further provides in relevant part that the special election shall be held not less than 102 days and not more than 131 days from the order calling the election except that it may be held on an election date regularly established by general law if that date falls within 270 days from the order calling the special election; and;

 

WHEREAS, this Board desires to call a special election to fill the vacancy on the Board of Supervisors for the Second District resulting from the resignation of Supervisor Hill, and to hold that special election on _______________________.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

1.

Pursuant to Section 203 of the San Mateo County Charter, the Board hereby calls a special election to fill the vacancy on the Board of Supervisors for the Second District resulting from the resignation of Supervisor Hill.

2.

The special election to fill this vacancy shall be held on ________________.

3.

The Assessor-County Clerk-Recorder shall set the filing dates and publish a notice of this special election in accordance with the County Charter and Elections Code.

4.

The special election shall be held and conducted, the returns canvassed, and the result declared in accordance with state election laws.

5.

The Assessor-County Clerk-Recorder shall prepare and mail to each eligible voter in the County a sample ballot and a voter’s pamphlet.

6.

The special election shall be consolidated with any and all other elections to be held on the date set for the election.
