SUBJECT:

APPOINTING COUNTY REPRESENTATIVES TO THE BOARD OF DIRECTORS OF THE SOUTH BAYSIDE WASTE MANAGEMENT AUTHORITY

 

RECOMMENDATION:

Adopt a resolution appointing the Director of Public Works as the County’s director on the Board of Directors of the South Bayside Waste Management Authority effective March 1, 2009, and designating the Public Works Department’s Waste Management and Environmental Services Manager as the County of San Mateo’s alternate member of the Board of Directors of The South Bayside Waste Management Authority effective immediately.

This action furthers the above-mentioned commitment and goal by appointing key County staff to an important organization in the County.

 

BACKGROUND:

In 1982 the County became a member of the South Bayside Waste Management Authority (SBWMA). The SBWMA is comprised of 12 jurisdictions: Atherton, Belmont, Burlingame, East Palo Alto, Foster City, Hillsborough, Menlo Park, Redwood City, San Carlos, the City of San Mateo, the County of San Mateo, and the West Bay Sanitary District. The purpose of the SBWMA is to provide for the joint ownership, financing, administration, and operation of the Shoreway Recycling and Disposal Center, and for the joint planning, adoption, financing, administration, management, review, monitoring, enforcement, and reporting of Solid Waste, Recyclable Material, and Plant Material Collection activities in the Service Area. The SBWMA’s Board of Directors consists of staff members from the 12 jurisdictions that comprise the SBWMA.

 

DISCUSSION:

Since the SBWMA’s inception, the County has been represented by Public Works staff at the Board of Directors of the SBWMA. Presently Brian Lee, a Deputy Director of Public Works, represents the County in that capacity. However, Brian Lee will retire from the County on March 31, 2009, and the County will need to appoint a replacement. The Public Works Department’s Waste Management and Environmental Services Manager has been an alternate representative for a several years.

 

The Joint Exercise of Powers Agreement for the SBWMA specifies that each member must select its Director or the Director’s designee alternate from among the following positions:

 
 

a.

County, District, City, or Town Manager or the equivalent position;

 
 

b.

County, District, City, or Town Assistant Manager or the equivalent position;

 
 

c.

Finance Director or Assistant Finance Director or the equivalent position;

 
 

d.

Public Works Director or Assistant Public Works Director or Environmental Programs Manager or the equivalent position.

 

Historically, appointment of representatives to the SBWMA Board by member agency has been informal without the requirement of any action by the member governing board. We believe that a formal appointment by your Board is appropriate considering the range of issues that the SBWMA Board considers. We recommend your appointment of the San Mateo County Public Works Director as the County of San Mateo’s representative to the SBWMA Board of Directors, and your designation of the Public Works Department’s Waste Management and Environmental Services Manager as the alternate.

 

FISCAL IMPACT:

There is no fiscal impact to the appointment. Participation at the SBWMA is included in the work programs of the Department of Public Works.
