Agreement with Liebert & Associates for a Functional Program Consultant

 

RECOMMENDATION:

Adopt a Resolution:

1.

Authorizing the President of the Board to execute an Agreement with Liebert & Associates, for functional programming services to assist the Jail Planning Unit with pre-architect planning, for a one (1) year term commencing January 1, 2009 through December 31, 2009, and an amount not to exceed $138,900; and

2.

Authorizing the Sheriff or the Sheriff’s designee to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

BACKGROUND:

In 2006, the County commissioned DMJM H&N to conduct a Needs Assessment designed to evaluate and quantify the scope of its jail overcrowding issue. DMJM H&N made recommendations on how many jail beds would be needed to solve the jail overcrowding, and account for potential future growth in inmate population. The Needs Assessment is now complete and the Sheriff is recommending that the next study, design and operational planning phase of the replacement jail be commenced.

In August 2008, Sheriff Munks, Supervisor Tissier, Assistant County Manager Boesch, and Lieutenant Bazan attended the National Institute of Corrections jail planning training. The National Institute of Corrections demonstrated the value and potential cost savings to contracting with a functional program consultant, prior to the selection of an architect.

 

DISCUSSION:

In November 2008, a Request for Proposals was developed and posted on the Sheriff’s web page. A selection committee was formed consisting of members from the Sheriff’s Office, Department of Public Works and the Correctional Health Department interviewed the five respondents. The committee ultimately selected the firm Liebert & Associates as the respondent offering the County the best work product, experience and value for this project.

Liebert & Associates has extensive experience with a number of pre-architectural planning functions directly related to the operation of the replacement jail. Those functions include site selection, staffing plans, operational cost estimates, stakeholder outreach, operational scenarios and a conceptual site master plan.

The Contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

County Counsel has reviewed and approved the resolution and agreement as to legal form.

 

FISCAL IMPACT:

The funding for this agreement is included in the Capital Projects Budget in the FY 2008-09 Adopted Budget.
