BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO SUBMIT APPLICATION TO THE CALIFORNIA OFFICE OF TRAFFIC SAFETY (OTS) FOR ACQUISITION OF A TRAFFIC COLLISION DATABASE SOFTWARE SYSTEM FOR FY 2009-2010

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County of San Mateo desires to submit an application to the California Office of Traffic Safety (OTS) for $30,000 in funding for Fiscal Year 2009-2010 to purchase and install a Traffic Collision Database Software application (herein referred to as PROJECT); and

WHEREAS, the Office of Traffic Safety (OTS) provides state funds for city and county projects which improve traffic safety data collection, access and analysis; and

WHEREAS, pursuant to OTS, and the regulations promulgated thereunder, eligible project sponsors wishing to receive OTS funds for a project shall submit an application first with OTS, for review by January 30, 2009; and

WHEREAS, the County of San Mateo is an eligible project sponsor for OTS funds; and

WHEREAS, as part of the application for the PROJECT funding, OTS requires a resolution adopted by the Board of Supervisors stating the following:

1)

the commitment by the County of San Mateo to meet the Performance Measurements as stated in the application; and

2)

that the County of San Mateo understands that the OTS funding is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with additional OTS funds; and

3)

the assurance of the County of San Mateo to complete the project as described in the application.

NOW, THEREFORE, BE IT RESOLVED that the Director of Public Works, on behalf of San Mateo County, is authorized to execute and file an application with the Office of Traffic Safety (OTS) for a Traffic Collision Database Software application; and

BE IT FURTHER RESOLVED that by adopting this resolution the County of San Mateo does hereby state that:

1)

The County of San Mateo understands that the OTS funding for the project is fixed at the OTS approved programmed amount, and that any cost increases must be funded by the County of San Mateo from other funds, and that the County of San Mateo does not expect any cost increases to be funded with additional OTS funding; and

2)

The County of San Mateo understands the funding deadlines associated with these funds and will comply with the provisions and requirements of the OTS policies; and

3)

The project to be completed with the OTS funds will be implemented by the County of San Mateo as described in the completed application subject to OTS funding approval in an amount of $30,000; and

There is no legal impediment to the County of San Mateo making applications for the funds; and

There is no pending or threatened litigation that might in any way adversely affect the proposed project, or the ability of the County of San Mateo to deliver such project; and

A copy of this resolution shall be transmitted to the OTS in conjunction with the filing of the application.
