RESOLUTION AWARDING AND AUTHORIZING EXECUTION OF A CONTRACT FOR THE LIGHTING RETROFIT AT THE SAN MATEO MEDICAL CENTER PROJECT TO LINC LIGHTING AND ELECTRICAL IN THE AMOUNT OF $220,431.99; AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE CHANGE ORDERS UP TO A MAXIMUM AMOUNT OF $33,065.01

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on December 9, 2008 adopt Resolution No. 69828, which resolution approved the specifications, determined the prevailing wage scales and called for the sealed proposals for the Lighting Retrofit at the San Mateo Medical Center Project; and

WHEREAS, the Clerk of this Board of Supervisors did, in public on December 30, 2008, open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 69828; and

WHEREAS, this Board of Supervisors has caused an analysis of said proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said sealed proposals and the analysis thereof; and

WHEREAS, the lowest responsible bid was submitted by Linc Lighting and Electrical, in the amount of Two Hundred Twenty Thousand Four Hundred Thirty-One and 99/100 Dollars ($220,431.99) based on an estimate of the amount of work to be done.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

It is in the best interest of the County of San Mateo to award the contract for the Lighting Retrofit at the San Mateo Medical Center Project to:

Linc Lighting and Electrical

2.

The County of San Mateo shall enter into a written agreement with Linc Lighting and Electrical, for the doing of said work as required by the plans and specifications therefore adopted and approved by this Board of Supervisors, as hereinbefore mentioned, said plans and specifications being on file in the office of the Director of Public Works of the County of San Mateo.

On behalf of the County of San Mateo, the President of this Board of Supervisors shall be, and is hereby, authorized and directed to execute an agreement with Linc Lighting and Electrical, for the work described herein, subject to the Department of Public Works receipt and approval of the Faithful Performance Surety Bond and the Payment Bond required to be posted by said Contractor in connection therewith.

All payments to the Contractor shall be in accordance with the plans, specifications, and other contract documents, based on the Director of Public Works’ written estimate of work actually done.

Paragraph 4 above notwithstanding, aggregate payment to Contractor shall not exceed the sum of Two Hundred Twenty Thousand Four Hundred Thirty-One Dollars and Ninety-Nine Cents ($220,431.99).

6.

The Director of Public Works is hereby authorized to execute change orders up to a maximum amount of Thirty-Three Thousand, Sixty-Five and 01/100 Dollars ($33,065.01).

7.

The Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
