RESOLUTION APPOINTING THE DIRECTOR OF PUBLIC WORKS AS THE COUNTY’S DIRECTOR ON THE BOARD OF DIRECTORS OF THE SOUTH BAYSIDE WASTE MANAGEMENT AUTHORITY EFFECTIVE MARCH 1, 2009, AND DESIGNATING THE PUBLIC WORKS DEPARTMENT’S WASTE MANAGEMENT AND ENVIRONMENTAL SERVICES MANAGER AS THE COUNTY OF SAN MATEO’S ALTERNATE MEMBER OF THE BOARD OF DIRECTORS OF THE SOUTH BAYSIDE WASTE MANAGEMENT AUTHORITY EFFECTIVE IMMEDIATELY

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, San Mateo County has, together with certain other public agencies (the “Member Agencies”), entered into Joint Exercise of Powers Agreement dated as of December 14, 2005 (the “JPA Agreement”), establishing the South Bayside Waste Management Authority (the “Authority”) for the purpose of providing for the joint ownership, financing, administration, and operation of the waste management facilities, and for the joint planning, adoption, financing, administration, management, review, monitoring, enforcement, and reporting of Solid Waste, Recyclable Material, and Plant Material Collection activities in the Service Area; and

WHEREAS, Section 8.1 of the current Authority JPA , provides that the Authority shall be governed and administered by a Board of Directors composed of one Director from each Member agency, and that each member must select its Director or the Director’s designee alternate from among the following positions: (a) County, District, City, or Town Manager or the equivalent position; (b) County, District, City, or Town Assistant Manager or the equivalent position; (c) Finance Director or Assistant Finance Director or the equivalent position; or (d) Public Works Director or Assistant Public Works Director or Environmental Programs Manager or equivalent position.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors of the County of San Mateo, State of California:

1.

Affirms the Deputy of Director of Public Works to continue serving as the County of San Mateo’s Director on the South Bayside Waste Management Authority Board until February 28, 2009;

2.

Appoints the Director of Public Works to serve as the County of San Mateo’s Director on the South Bayside Waste Management Authority Board effective on March 1, 2009; and

3.

Appoints the Waste Management and Environmental Services Manager as the alternate County Director on the Board of Directors of the South Bayside Waste Management Authority effective immediately.
