RESOLUTION:

1.

AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH LIEBERT & ASSOCIATES FOR FUNCTIONAL PROGRAMMING SERVICES TO ASSIST THE SHERIFF'S OFFICE JAIL PLANNING UNIT WITH PRE-ARCHITECT PLANNING, FOR A ONE (1) YEAR TERM COMMENCING JANUARY 1, 2009 THROUGH DECEMBER 31, 2009, AND IN AN AMOUNT NOT TO EXCEED $138,900; AND

2.

AUTHORIZING THE SHERIFF OR THE SHERIFF’S DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY'S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, in November 2008, a Request for Proposals was developed for a functional programming consultant to assist the Sheriff’s Office Jail Planning Unit with pre-architect planning; and

WHEREAS, a selection committee was formed consisting of members from the Sheriff’s Office, Department of Public Works and the Correctional Health Department; and interviewed the five respondents; and

WHEREAS, out of the five respondents, the committee ultimately selected the firm Liebert & Associates as the respondent offering the County the best work product, experience and value for this project; and

WHEREAS, Liebert & Associates has extensive experience with a number of pre-architectural planning functions directly related to the operation of the replacement jail; and

WHEREAS, the County wishes to contract with Liebert & Associates for the provision of functional programming services for a one year term commencing January 1, 2009 through December 31, 2009, and an amount not to exceed $138,900; and

WHEREAS, this Board has been presented with a form of such Agreement, has examined and approved same as to both form and content, and desires to enter into same:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED THAT THE:

1.

President of this Board of Supervisors be, and is hereby authorized to, execute the Agreement with Liebert & Associates, for and on behalf of the County of San Mateo, and the Clerk of this Board of Supervisors shall attest the President’s signature thereto; and

2.

The Sheriff and/or the Sheriff’s designee are authorized to execute contract amendments which modify the county's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
