RESOLUTION MODIFYING THE OPERATIONS OF THE NORTH FAIR OAKS COUNCIL

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, pursuant to California Government Code Section 31010, the Board of Supervisors may by resolution establish a municipal advisory council for an unincorporated area in the County to advise the Board on such matters which relate to that unincorporated area, including but not limited to advice on matters of public health, safety, welfare, public works, and planning; and

 

WHEREAS, this Board has previously, by Resolution No. 54597 and Resolution No. 63547, established and modified the operations of the North Fair Oaks Council; and

 

WHEREAS, this Board now wishes to further modify the Council’s operations.

 

    NOW THEREFORE, IT IS HEREBY RESOLVED AND ORDERED as follows:

1. The Board of Supervisors hereby establishes a municipal advisory council for the unincorporated North Fair Oaks community to be known as the “North Fair Oaks Council." The unincorporated North Fair Oaks community, comprised of Census Tracts 6105, is generally bounded by Bay Road, Marsh Road, 17th Avenue, Oak Drive, Encina Avenue, Loyola Avenue, El Camino Real, Northumberland Avenue, Charter Street, Middlefield Road, Douglas Avenue, Spring Street, and Willow Street. Precise boundaries are set forth on the map attached herewith, entitled "Jurisdictional Boundaries, North Fair Oaks Council, December 1990." The establishment of the North Fair Oaks Council shall be by resolution adopted by the Board of Supervisors and shall not be by submission to the voters.

2. The North Fair Oaks Council shall consist of no fewer than five (5) members and no more than nine (9) members, each of whom shall be appointed by and serve at the pleasure of the Board of Supervisors. The designated number of members of the North Fair Oaks Council shall be set at the Council’s regular meeting in July of each year, and the designated number of members shall neither be increased nor decreased until the Council’s regular meeting in July of the following year. The terms of office for each member shall be three years, and each member shall be limited to four full three-year terms. The membership shall be composed of individuals who are either residents (homeowners or renters) of the North Fair Oaks area or representatives or owners of business located in the North Fair Oaks area. In addition to the Council’s established membership, the Council may include one youth member, who shall be non-voting.

3. There shall be no stipend, compensation or other reimbursement of expenses for appointed members of the North Fair Oaks Council

4. The North Fair Oaks Council is established solely as an advisory body to the San Mateo County Board of Supervisors. The North Fair Oaks Council shall not have the authority to represent the community directly to any state, any county other than San Mateo County, city, special district or school district, agency or commission, or any other organization on any matter concerning the community.

5. The North Fair Oaks Council, as an advisory body representing the community to the San Mateo County Board of Supervisors, shall hold regular community meetings to provide a forum for community concerns. The North Fair Oaks Council may conduct community surveys, disseminate information to and from County departments, serve as liaison for community services, and develop support for County activities.

6. All meetings of the North Fair Oaks Council shall be open and public and shall be subject to all requirements of the Brown Act, Government Code Sections 54950 et seq.

7. The North Fair Oaks Council shall establish the date, time and place for its regular meetings.

8. The North Fair Oaks Council shall adopt rules of procedure for conduct of meetings, which rules shall be consistent with this resolution and with any resolutions of this which specify standing rules for County boards, commissions, and advisory committees. In the event of an inconsistency between this resolution, resolutions of this board that specify standing rules for County boards, commissions, and advisory committees and/or the Council’s rules of procedure, this resolution shall control. The rules of procedure shall provide for selection of a Council chair, vice chair and secretary.

9. The North Fair Oaks Council shall solicit community participation in its activities and community participation in the provision of translation services, when necessary.

10. The Council is subject to all provisions of the Ralph M. Brown Act, California Government Code §54950 et seq., which Act mandates open meetings for local legislative bodies.

11. The Council is subject to all applicable county policies regarding non-discrimination.

12. The Council is required to comply with the disclosure requirements of the Political Reform Act of 1974, and the members must complete all necessary documents in connection therewith.

13. Members the Council are subject to applicable California laws regarding conflicts of interests.

14. Members of the council shall avoid impropriety and the appearance of impropriety, and shall not use their position to further their own pecuniary gain or for any other purpose not directly related to the governmental function which they have been appointed to perform.
