RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD
TO CONCURRENTLY EXECUTE

(1) A SECOND AMENDMENT TO LEASE AGREEMENT WITH 1390 EL CAMINO REAL, LLC, FOR OFFICE SPACE AT 1390 EL CAMINO REAL, SAN CARLOS, ACKNOWLEDGING THE SUCCESSOR IN INTEREST TO THE LANDLORD, AMENDING THE TERM TO MONTH-TO-MONTH, AMENDING THE AREA OF THE PREMISES TO 1,795 SQUARE FEET, AND AMENDING THE MONTHLY RENT TO $3,410.50, AND

(2) A THREE-YEAR LEASE WITH THREE OPTIONS TO EXTEND FOR ONE YEAR EACH WITH 1390 EL CAMINO REAL, LLC OF 1,857 SQUARE FEET OF OFFICE SPACE AT 1390 EL CAMINO REAL, SAN CARLOS, AT AN INITIAL MONTHLY RENT OF $3,528.30, AND

AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO EXECUTE NOTICES, OPTIONS AND DOCUMENTS ASSOCIATED WITH SUCH SECOND AMENDMENT AND SUCH LEASE INCLUDING, BUT NOT LIMITED TO, EXTENSION OR TERMINATION OF THE AGREEMENTS UNDER THE TERMS SET FORTH THEREIN. (LEASE NOS. 1261 AND 1288)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on July 15, 2003, the County of San Mateo and Raymond Barri and Melodi Gheno-Barri and Glenn and Elizabeth Romig (Landlord), as authorized by Resolution No. 66136, entered into a Lease Agreement for office space at 1390 El Camino Real, San Carlos, California (the “Building”), for the Probation Department; and

WHEREAS, on June 21, 2005, the County and the Landlord, as authorized by Resolution No. 67369, entered into a First Amendment to Lease, amending the term of the Lease and providing the County options to further extend the term; and

WHEREAS, subsequent to such First Amendment, Landlord sold the Building to 1390 El Camino Real, LLC, successor in interest to the Landlord; and

 

WHEREAS, the parties wish to further amend the Lease acknowledging 1390 El Camino Real, LLC as successor in interest to the Landlord, modifying the term to month-to-month, amending the size of the Premises to 1,795 square feet, and amending the base rent to $3,410.50 per month, and otherwise under the same terms and conditions set forth in the Lease, and

 

WHEREAS, the Probation Department is vacating 1,857 square feet of office space that is sufficient to meet the current needs of the Sheriff’s Jail Planning Unit, and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a three-year lease of real property (“Lease”), reference to which is hereby made for further particulars, whereby the County of San Mateo shall lease approximately 1,857 square feet of office space at an initial monthly rent of $3,528.30, from 1390 El Camino Real, LLC, at 1390 El Camino Real, San Carlos, in accordance with the terms and conditions contained in said agreement, and

 

WHEREAS, the Second Amendment and the Lease shall commence concurrently on February 10, 2009, and the Lease expires on January 31, 2012, subject to the County’s three options to extend the term for one year each; and

 

WHEREAS, this Board has been presented with such Second Amendment to Lease and such Lease and has examined and approved same as to both form and content and desires to enter into same.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute concurrently such Second Amendment to Lease and such Lease for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to accept or execute on behalf of the County, any and all notices, options and documents associated with the Second Amendment and the Lease including, but not limited to, extension or termination of the agreement under the terms set forth therein.
