Job Order Contract General Construction Contract

 

RECOMMENDATION:

Adopt a resolution:

 

1.

Adopting the construction plans, specifications, and conformance with prevailing wage scale requirements for the San Mateo County Job Order Contract General Construction Contract with application throughout the County;

 

2.

Authorizing the publication of a Notice to contractors twice in a local newspaper; and

 

3.

Authorizing the Director of Public Works to call for bids on Thursday, April 2, 2009, at 2:30 p.m., in the office of the Clerk of the Board of Supervisors.

Your Board’s adoption of the proposed resolution will provide staff with a powerful tool to reduce both the cost and time required to execute major maintenance and renovation projects throughout all county facilities.

 

BACKGROUND:

Job Order Contracting is a method of project delivery whereby a general contractor agrees to perform literally tens of thousands of defined tasks for a corresponding set fee. The bid package is a highly defined list of tasks with corresponding prices tailored to the market where the work will be performed. Contractors bid a “factor” to be applied to all included tasks and bids are evaluated on that basis. Job Order Contracting has been a project delivery tool for over twenty years and has been utilized extensively by the federal government. It is now being utilized at State and Local levels throughout the country. California Public Contract Code provides counties the authority to utilize Job Order Contracts on an annual basis for up to $4,000,000.

 

DISCUSSION:

Your Board previously approved a contract with The Gordian Group to assist the County in establishing and managing Job Order Contracts. This consultant has tailored specifications to meet the needs of the Public Works Department in support of major maintenance and renovation projects. The Gordian Group has completed assembly of the appropriate bid documents and we are now ready to call for bids. This will be the first of many JOC contracts to be presented to the Board as State Law limits the term of JOC contracts to one year. Further, the Department anticipates separate JOC contracts tailored to road maintenance and improvement tasks.

 

The resolution has been approved as to form by County Counsel.

 

FISCAL IMPACT:

The Job Order Construction Contract is a requirements contract. Therefore, there is no budget associated with this contract and the letting of this contract will not impact the General Fund. Specific job orders issued under the terms of this agreement will be reimbursed by the work authorization established for the task to be performed.
