BOARD OF SUPERVIORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION: 1.  APPROVING THE SELECTION OF NORCAL WASTE SYSTEMS TO PROVIDE REFUSE COLLECTION SERVICES FOR COUNTY SERVICE AREA 8 (CSA8) AND OTHER CURRENTLY NON-FRANCHISED UNINCORPORATED AREAS WITHIN THE SOUTH BAYSIDE WASTE MANAGEMENT AUTHORITY (SBWMA) SERVICE AREA, AND 2.  DIRECTING THE DIRECTOR OF PUBLIC WORKS TO NOTIFY ALL KNOWN HOMEOWNERS ASSOCIATIONS OR ADVISORY AGENCIES IN THE AFFECTED UNINCORPORATED AREAS OF THE SELECTION.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, that certain franchise agreement entitled, Franchise Agreement Between The County Of San Mateo and BFI Waste Systems Of North America, Inc. For Solid Waste, Recyclable Materials And Plant Materials Collection Services was approved by the County of San Mateo on February 8, 2000; and

WHEREAS, said Franchise Agreement expires on December 31, 2010; and

WHEREAS, San Mateo County has, together with certain other public agencies (the “Member Agencies”), entered into a First Amended and Restated Joint Exercise of Powers Agreement dated as of December 14, 2005, establishing the South Bayside Waste Management Authority (the “Authority”) for the purpose, among others, joint planning of collection activities; and

WHEREAS, the Board of Supervisors on January 9, 2007 approved the criteria for providing garbage service pursuant to uniform garbage franchises that are proposed to be negotiated between Member Agencies of the Authority and private collector(s) beginning in January 2011; and

WHEREAS, the Authority has issued request of proposal on behalf of its Member Agencies for the refuse collection services; and

WHEREAS, the Authority has evaluated the proposals received and recommended to Member Agencies that Norcal Waste Systems be selected to provide refuse collection services; and

WHEREAS, the Director of Public Works concurs with the Authority’s recommendation; and

WHEREAS, this Board of Supervisors has duly considered such recommendation.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors of the County of San Mateo, State of California:

1.

Approves the Selection of Norcal Waste Systems to provide refuse collection services for the County Service Area 8 (CSA8) and other currently non-franchised unincorporated areas within the South Bayside Waste Management Authority (SBWMA) service areas; and

2.

Directs the Director of Public Works to notify all known homeowners associations or advisory agencies in the affected unincorporated areas of the selection.
