RESOLUTION AUTHORIZING AND DIRECTING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE THE JUNCUS RAVINE AND REMAINDER LANDS DEDICATION AND AGREEMENT AND EXECUTE AN ACCEPTANCE OF SUCH TRANSFER AND TO AUTHORIZE THE COUNTY MANAGER TO EXECUTE SUCH OTHER DOCUMENTS AS MAY BE NECESSARY TO EFFECTUATE THE AGREEMENT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Terrabay Partners, LLC, (“Terrabay”) and Myers Peninsula Company, LLC (“Myers”) are the owners in fee title of certain properties commonly known as Juncus Ravine and the Remainder Lands, located in the South Slope area of San Bruno Mountain; and

WHEREAS, the San Bruno Mountain Habitat Conservation Plan (“HCP”) requires that these parcels be dedicated in fee title to the County of San Mateo for inclusion in San Bruno Mountain County Park as Conserved Habitat; and

WHEREAS, the Board has been presented a form of agreement which would provide for the transfer in fee title of the three remainder parcels, and the payment of $9,500 for certain debris removal activities on the Juncus Ravine property; and

WHEREAS, the Board has reviewed the proposed agreement and desires to enter into same;

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board of Supervisors is hereby authorized and directed to execute the proposed Juncus Ravine and Remainder Lands Dedication and Agreement and an acceptance of such transfer, and the County Manager is hereby directed and authorized to execute such other documents as may be necessary to effectuate the Agreement.
