SUBJECT:

Adopt a Resolution Authorizing the Director of Public Works to Submit a Financial Assistance Application for the American Recovery and Reinvestment Act of 2009 Funds

 

RECOMMENDATION:

Acting as the governing board of the ten County Sewer Maintenance/Sanitation Districts, adopt a resolution authorizing the Director of Public Works to submit a Financial Assistance Application to the State Water Resources Control Board for the American Recovery and Reinvestment Act of 2009 (ARRA) funds to rehabilitate sanitary sewer facilities in the various Districts.

Authorizing the Director of Public Works to submit the application to the State Water Resources Control Board for financial assistance to fund sewer projects will position the Districts to meet the deadlines imposed by the ARRA for construction of the projects, which will benefit the public by improving existing sewer facilities that have been identified for replacement.

 

BACKGROUND:

The Sewer Master Plans prepared in 1999/2000 for nine of the ten Districts recommended Capital Improvement Program (CIP) projects estimated to cost approximately $12.9 million to correct sewer facility issues related to: lack of capacity, structural deficiencies (cracked pipes), or excessive operation and maintenance expenses. One of the ten districts does not require any Capital Improvements at this time.

 

The CIP projects as well as subsequently identified projects are located in the following Districts:

 

    1.

Burlingame Hills Sewer Maintenance District

    2.

Crystal Springs County Sanitation District

    3.

Devonshire County Sanitation District

    4.

Emerald Lake Heights Sewer Maintenance District

    5.

Fair Oaks Sewer Maintenance District

    6.

Harbor Industrial Sewer Maintenance District

    7.

Kensington Square Sewer Maintenance District

    8.

Oak Knoll Sewer Maintenance District

    9.

Scenic Heights County Sanitation District

 

DISCUSSION:

The ARRA is anticipated to provide grants to the Clean Water State Revolving Fund (CWSRF) Program administered by the State Water Resources Control Board (SWRCB). In order for projects to be eligible for consideration to receive CWSRF funding, local agencies must submit applications to the SWRCB. A resolution authorizing a representative to sign and submit the financial assistance application is required to be adopted by the governing board of an agency.

 

The Department of Public Works plans to submit projects in the Districts listed above to the SWRCB to request funding through the ARRA.

 

The State Water Resources Control Board requires that the projects must obtain environmental clearance prior to receiving funding. When Public Works is notified about the availability of the funds, we will return to the Board with the individual projects so that California Environmental Quality Act (CEQA) determinations can be made on a case-by-case basis.

 

Plans and specifications for the projects will be prepared by the Department.

 

The resolution has been approved as to form by County Counsel.

 

FISCAL IMPACT:

The projects are estimated to cost approximately $12.9 million and the number of projects to be completed will depend on the amount of funds made available to the Districts through the ARRA. The ARRA funding will be in the form of grants or low interest loans. The low interest loans will be repaid by District revenue from the Sewer Service Charges levied for each District.

 

There is no impact to the General Fund.
