SUBJECT:

2009 Bayside Cape and Slurry Seal Project in the Emerald Lake Hills Area (Project No. RL803, F-36 [392])

 

RECOMMENDATION:

Adopt a resolution:

 

1)

Awarding and authorizing execution of a contract with Valley Slurry Seal Co. in the amount of $251,184.26 for the 2009 Bayside Cape and Slurry Seal Project in the Emerald Lake Hills Area (Project No. RL803, F-36 [392]), and

 

2)

Authorizing the Director of Public Works to execute contract change orders in an amount not to exceed $25,100 or approximately 10% of the contract amount.

Adoption of this resolution contributes to this commitment and goal by substantially improving the condition of the road for the benefit of the public.

 

BACKGROUND:

 

PREVIOUS BOARD ACTION:

1.

Adopted Resolution No. 069929 on February 10, 2009, which adopted plans and specifications, including conformance with prevailing wage rates scale requirements, and called for sealed proposals for the above-mentioned project.

   

2.

Authorized the Director of Public Works to develop plans and specifications for non-federally funded maintenance type projects on various County roads utilizing funds available to the County pursuant to Proposition 1B (State Transportation Bond).

 

DISCUSSION:

On Tuesday, March 3, 2009, bids were accepted for this project and subsequently referred to this office for checking and recommendation. The bid of:

 

Valley Slurry Seal Co.

at $251,184.26 was the lowest bid received.

 

The Engineer’s estimate was $326,000. A summary of the bids received is attached as Exhibit “A”.

 

Staff has reviewed the contract documents and has determined that the Equal Employment program submitted by Valley Slurry Seal Co. is in accordance with the current Equal Employment Guidelines, and that the Contractor complies with the equal benefits and jury duty pay provisions of the County ordinance code.

 

The resolution has been approved as to form by County Counsel.

 

FISCAL IMPACT:

The total estimated cost for construction is $276,300.00, which includes a ten percent (10%) contingency (approximately $25,100.00) as the work is bid on a unit price basis (i.e., per square yard for cape or slurry seal placed, per square yard of pavement repair areas, etc.). The contingency is used to pay the contractor for any additional material placed for the various bid items as the actual quantity used depends on the unit weight and actual limits of the construction project, or to pay for added work resulting from unforeseen conditions not anticipated in the construction contract documents.

 

The project is proposed to be financed with Proposition 1B funds. Funds have been appropriated in the Road Fund to finance this work.

 

There is no impact to the General Fund.
