ACTING AS THE GOVERNING BOARD OF THE EMERALD LAKE HEIGHTS SEWER MAINTENANCE DISTRICT

RESOLUTION AUTHORIZING AN INCREASE OF $20,000 IN THE “NOT-TO-EXCEED” PAYMENT LIMIT FOR CONTRACT COSTS FOR THE REPAIR OF THE SANITARY SEWER LINES DAMAGED BY LANDSLIDES IN THE VICINITY OF PARK ROAD AND SPRINGDALE WAY IN THE EMERALD LAKE HILLS AREA, FOR A REVISED “NOT TO EXCEED” AMOUNT OF TO $291,018 (PROJECT NO. SE002, F-351 [25C]).

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the governing board of the Emerald Lake Heights Sewer Maintenance District (District), that

 

WHEREAS, this Board of Supervisors did, on August 12, 2008, adopt Resolution No. 069646, which Resolution awarded and authorized the execution of an agreement with Casey Construction, Inc., for the repair of sanitary sewer lines damaged by landslides in the vicinity of Park Road and Springdale Way in the Emerald Lake Hills Area, and authorized aggregate payments to Casey Construction, Inc. in an amount not to exceed Two Hundred Seventy-One Thousand Eighteen and 00/100 Dollars ($271,018.00); and

 

WHEREAS, the County did enter into an agreement with Casey Construction, Inc., as authorized by said resolution, and the work has been performed; and

 

WHEREAS, changes in the project due to unforeseen conditions discovered during construction have increased the overall contract cost to an amount greater than was originally authorized by this Board; and

 

WHEREAS, the Director of Public Works has recommended that the not-to-exceed figure as originally approved by this Board be increased to provide for the unforeseen work; and

 

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that Resolution No. 069646 is amended to increase the not to exceed amount for the project to the sum of Two Hundred Ninety-One Thousand Eighteen and 00/100 Dollars ($291,018.00) and the Director of Public Works is hereby authorized to execute change orders for the increased amount.
