RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE CONTRACT REVISION ORDERS IN ADDITION TO THE PREVIOUSLY AUTHORIZED CONTRACT REVISION ORDERS, WITH THE UNDERSTANDING THAT THE CONTRACT REVISION ORDERS AUTHORIZED BY THIS RESOLUTION SHALL NOT EXCEED $33,882 IN TOTAL, FOR AN AGGREGATE AUTHORITY IN AN AMOUNT NOT TO EXCEED $69,402

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Board of Supervisors did, on December 16, 2008, adopt Resolution No. 069851, which Resolution authorized and directed the President of said Board to execute a Contract with Rockaway Construction Inc., for the Accessibility Improvements, 2nd, 3rd, 4th and 5th Floor Toilet Rooms Project; and

 

WHEREAS, the Board of Supervisors also by said Resolution did authorize the Director of Public Works to execute contract revision orders related to the Project not exceeding $35,520, which is 15% of the contract amount; and

 

WHEREAS, Rockaway Construction, Inc. was awarded this contract and did start work on the project as scheduled, on February 20, 2009, and upon completing the demolition part of the works, did find the presence of hazardous materials in the form of asbestos and lead containing tile and adhesives, as well as pipe insulation, all of which were substantiated by an independent consultant report; and

 

WHEREAS, the Department of Public Works authorized the expenditure of $33,882 for the abatement of said hazardous material from its previously authorized revision order amount of $35,520 to enable the safe and timely progress of the work; and

 

WHEREAS, said unforeseen expenditure of $33,882 having depleted the aforementioned authorized amount of $35,520 for the remainder of the project,

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

In addition to the previously authorized contract revision orders in the amount of $35,520 that the Board of Supervisors authorized the Director of Public Works to make for the agreement with Rockaway Construction Inc., for the Accessibility Improvements, 2nd, 3rd, 4th and 5th Floor Toilet Rooms Project, the Director of Public Works shall be and is hereby authorized to execute additional contract revision orders related to the Accessibility Improvements not exceeding $33,882 in aggregate, for an aggregate authority in an amount not to exceed $69,402.
