RESOLUTION AUTHORIZING THE COUNTY COUNSEL TO 1) EXECUTE AN AGREEMENT FOR LEGAL SERVICES WITH HANSON, BRIDGETT, MARCUS, VLAHOS & RUDY, LLP FOR THE TERM OF FEBRUARY 1, 2009 THROUGH JUNE 30, 2012, FOR A TOTAL OBLIGATION OF $150,000; AND 2) EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $50,000 (IN AGGREGATE) AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, pursuant to Government Code section 31529, the County Counsel is the attorney for the San Mateo County Employees’ Retirement Association (“SamCERA”); and

WHEREAS, the County Counsel has determined for certain tax and benefit matters, the services of Hanson, Bridgett, Marcus, Vlahos & Rudy, LLP can provide assistance to my office in its representation of SamCERA and the County; and

WHEREAS, SamCERA will reimburse the County Counsel for the cost of the services provided by Hanson, Bridgett, Marcus, Vlahos & Rudy, LLP in regards to SamCERA matters; and

WHEREAS, this Board has been presented with a form of the Agreement and has examined and approved it as to both form and content and desires to authorize the County Counsel to enter into this Agreement; and

WHEREAS, agreements for legal services in an amount up to $50,000 may be approved and entered into by the County Counsel:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the County Counsel be and is hereby authorized and directed to execute said Agreement and is further authorized to execute contract amendments which modify the maximum fiscal obligation by no more than $50,000 (in aggregate) and/or modify the contract term and/or services.
