RECOMMENDATION

 

Adopt a Resolution:

 

A.

Accepting the corrected legal description of affected parcel, as an attachment to the previously approved affordable housing Regulatory Agreement.

   

B.

Directing the Community Development Director or her designee to re-record the corrected agreement and any other documents that may be required to implement the affordable housing agreement.

   

VISION ALIGNMENT

 

Commitment: Offer a Full Range of Housing Choices. The proposal for an affordable housing unit, which this contract agreement formally implements, fulfills this commitment.

 

Goal: Number 9, which states: “Housing exists for people at all income levels and for all generations of families.” The project contributes to this commitment and goal by providing for housing available to residents who might otherwise not be able to afford housing due to income limitations.

 

BACKGROUND

 

A Regulatory Agreement was originally approved and adopted in December 2005 with an incorrect legal parcel description. The correct legal parcel description is attached to this report. The previously approved affordable housing remains the same. The project included an existing 1,230 sq. ft. modular unit used as affordable housing. The subject 44.5-acre parcel is zoned Planned Agricultural District and is developed with an existing single-family dwelling, the subject affordable housing unit and a barn.

 

The Local Coastal Program provides 30 “floating” density credits total which can be used to provide affordable housing in the rural South Coast. Staff determined there are 25 existing affordable housing units to date, which includes the previously approved project.

 

This affordable unit continues to qualify for that program and was found to be in compliance with all applicable policies of the Local Coastal Program; a Coastal Development Permit for the project was approved on December 6, 2005.

 

SUMMARY

 

On December 6, 2005, the San Mateo County Board of Supervisors approved a Regulatory Agreement for an affordable housing unit on a 44.5-acre parcel in the Coastal Zone. The Regulatory Agreement, which is a recorded document, is between the Developer/Owner and the County that binds the Developer/Owner to provide and maintain the subject unit as affordable housing for no less than 55 years. After the execution of this agreement, it was discovered that the agreement did not include the correct legal description of the subject parcel as an attachment. This amended agreement corrects the parcel description. In all other ways, the agreement remains unchanged.
