SUBJECT:

Appointment of members for the Independent Hearing Panel for the Solid Waste Management Program

 

RECOMMENDATION:

Approve a Resolution authorizing the appointment of three members for the Independent Hearing Panel for the Solid Waste Management Program.

 

BACKGROUND:

Environmental Health Services (EHS) was designated as the Local Enforcement Agency (LEA) in 1992. EHS is responsible for performing solid waste enforcement activities in the entire County’s incorporated and unincorporated areas. EHS was approved for designation by a majority of the cities within the County and was approved by the City/County Association of Governments (CCAG).

 

California Public Resource Code, Chapter 4, Article 2, Section 44308(a)(2), requires the establishment of an Independent Hearing Panel for all LEA jurisdictions. This panel shall conduct hearings for permit and enforcement appeals. Panel members shall serve for a term of four years and may serve more than one term but not more than two consecutive terms. The members of the hearing panel are John Lisenko, John Plock, and Joel Patterson. They were appointed by your Board in 2002 and have reached their term limits.

 
 
 
 
 

DISCUSSION:

Section 44308 requires that members of the independent hearing panel be selected for their legal, administrative, or technical abilities in areas relating to solid waste management methods and technology and at least one member be a representative of the public at large

 

EHS submits the following names for consideration for appointment to the Independent Hearing Panel:

 

    1. Stan Chow, Registered Environmental Health Specialist for Santa Clara County.
    Mr. Chow has over 12 years experience in an LEA in permitting and inspections of solid waste facilities, and 10 years experience in drinking water programs. He is a member of the Recycling and Waste Reduction Commission of Santa Clara County. Education: BA Environmental Biology, University Colorado, Boulder.

 

    Keith Hashiguchi, Registered Environmental Health Specialist for San Mateo County (retired).
    Mr. Hashiguchi is recently retired from the San Mateo County Environmental Health Division. Mr. Hashiguchi served the division for 35 years as a supervisor of Consumer Protection Programs. Education: BS Environmental Health Sciences, San Jose State University.

 

    Marc Schuyler, lawyer practicing in Saratoga, CA.
    Mr. Schuyler has over 19 years of law practice, 12 years at Hewlett Packard as Director and Managing Counsel. He has experience in patent litigation, counseling, licensing, assertion and prosecution background. Education: Caltech, BS engineering 1986; UCLA, J.D. 1989; Admitted to the California Bar 1989 (Bar No. 143738); admitted to practice before CA District Courts (all districts) and US Courts of Appeal for the 9th and Federal Circuits.

FISCAL IMPACT:

There is no fiscal impact to the designation of the Independent Hearing Panel. The panel will meet only when an appeal of permit and enforcement conditions exist. There is no Net County Cost.
