RESOLUTION A) AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH SWIFT ATTORNEY SERVICE TO PROVIDE PROCESS SERVICE FOR THE TERM OF JULY 1, 2009 THROUGH JUNE 30, 2012, IN AN AMOUNT NOT TO EXCEED $540,000.00, AND B) AUTHORIZING THE DIRECTOR OR THE DIRECTOR’S DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICE IS WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County of San Mateo Department of Child Support Services obtains and enforces orders for child support and health insurance; and

WHEREAS, the establishment and enforcement of child support orders and orders for the provision of health insurance require the legal service of process of court documents on alleged and established obligors; and

WHEREAS, on February 10, 2009, the County of San Mateo issued a Request for Proposals for process service; and

WHEREAS, the Department of Child Support Services received two (2) proposals and interviewed one (1) finalist; and

WHEREAS, Swift Attorney Service was selected based on years of experience serving child support documents, client references and cost; and

WHEREAS, an agreement has been presented to this Board of Supervisors for its consideration and acceptance, reference to which is hereby made for further particulars, whereby Swift Attorney Service will provide process service for the Department of Child Support Services for the period commencing July 1, 2009 through and including June 30, 2012; and

WHEREAS, this Board has been presented with a form of the Agreement and has examined and approved it as to both form and content and desires to enter into the Agreement; and

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest his signature thereto.

BE IT FURTHER RESOLVED that the Director of the Department of Child Support Services or the Director’s designee shall be authorized to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000.00 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
