RESOLUTION AUTHORIZING A THIRD AMENDMENT

TO THE AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND IMPACT SCIENCES, INC. FOR PREPARING DRAFT AND FINAL ENVIRONMENTAL IMPACT REPORTS FOR THE TICONDEROGA/HIGHLAND ESTATES SUBDIVISION TO EXTEND THE TERM FROM DECEMBER 31, 2009 TO DECEMBER 31, 2010 AND TO INCREASE THE MAXIMUM AMOUNT PAYABLE THEREUNDER BY $86,270 FROM $185,565 TO $271,835

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that:

 

WHEREAS, on February 27, 2007, the County of San Mateo authorized an Agreement with Impact Sciences, Inc. (Resolution 68577) in the amount of $114,305 for the term of February 27, 2007 to June 30, 2008 to prepare a Draft Environmental Impact Report and a Final Environmental Impact Report for the Ticonderoga/Highland Estates Subdivision; and

 

WHEREAS, on October 7, 2008, this Board authorized a First Amendment to the Agreement (Resolution 69723) to increase the maximum amount payable thereunder by $57,580, from $114,305 to $171,885, to modify the Agreement’s Scope of Work, and to extend the Agreement term to December 31, 2009; and

 

WHEREAS, on December 31, 2008, the Community Development Director authorized a Second Amendment to the Agreement to increase the maximum amount payable thereunder by $13,680, from $171,885 to $185,565; and

 
 

WHEREAS, the parties now wish to enter into a Third Amendment to the Agreement to increase the maximum amount payable thereunder by $86,270, from $185,565 to $271,835, to further modify the Agreement’s Scope of Work, and to extend the Agreement’s term from December 31, 2009 to December 31, 2010; and

 

WHEREAS, the Board has been presented with and has considered, as to both form and substance, this Third Amendment to the Agreement and desires to enter into it.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Third Amendment to the Agreement for and on behalf of the County of San Mateo, and the Clerk of this said Board shall attest the President’s signature thereto.
