Agreement with 21ST Century Environmental Management of California LP

 

RECOMMENDATION:

Adopt a Resolution:

1.

Authorizing the execution of an Agreement with 21ST Century Environmental Management of California LP to process hazardous waste from the County’s various household hazardous waste facilities for the term of June 1, 2009 through June 30, 2012 at an amount not to exceed $2,300,000; and

2.

Authorizing the Chief of Health System or designee to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

The Agreement with 21ST Century Environmental Management of California LP contributes to this commitment and goal by ensuring that household hazardous waste does not pose a health and safety danger to residents or cause environmental damage through improper disposal onto lands or waterways.

BACKGROUND:

The current agreement to process and dispose of hazardous waste is with 21st Century Environmental Management of California LP. The contract ends on May 31, 2009.

The Environmental Health Services Division (EH), with the help of the Purchasing Division, conducted a Request for Proposals (RFP) to process and dispose of hazardous waste on February 11, 2009. 21st Century Environmental Management of California LP met all the requirements of the RFP and was chosen based on its ability to provide equipment, supplies, and labor; on its ability to collect, transport and dispose of waste for the Household Hazardous Waste (HHW) Program and on its experience in the industry.

 

DISCUSSION:

EH operates a HHW Program that collects and safely processes HHW from residents. During the past four years, the number of homes served has remained consistent, between 900 and 1,000 per month. The annual hazardous waste volume averages nearly 620 tons. The State Department of Toxic Substance Control continues to add new items that are required to be managed as hazardous waste, thereby increasing staff workload.

Improved program operations include new curbside battery recycling services managed by the garbage haulers, new universal waste Take-It-Back opportunities managed by others, and full in-house staffing within the HHW Program.

The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits. County Counsel and Risk Management have reviewed and approved this Agreement.

FISCAL IMPACT:

The term of the Agreement with 21st Century Environmental Management of California LP is June 1, 2009 through June 30, 2012; with a maximum amount payable of $2,300,000. The maximum amount of the previous agreement was $2,381,000. The decrease is due to improvements in program operations. The Agreement is funded through Solid Waste Funds. An appropriation of $750,000 is included in the Environmental Health FY2009-10 Recommended Budget. There is no Net County Cost.
