SUBJECT:

Third Amendment to Agreement with Horizon Services, Inc.

 

RECOMMENDATION:

Adopt a Resolution authorizing the President of the Board to execute a Third Amendment to the Agreement with Horizon Services, Inc., for the provision of alcohol and drug treatment services, increasing the maximum obligation by $2,099,112, for a new maximum obligation of $3,025,274, and extending the term to January 1, 2008 through June 30, 2010.

Behavioral Health and Recovery Services (BHRS) provides a range of services to promote wellness and recovery and to support clients  to maintain abstinence and sobriety.  The provision of substance abuse treatment services provided through this Agreement contributes to this measure.

BACKGROUND:

In November 2006 your Board approved the Alcohol and Other Drug Strategic Plan, “Strategic Directions 2010.” As part of the implementation of the plan a Request For Proposals (RFP) process was initiated in April 2007 to select providers of treatment services. The initial contracts awarded as a result of the RFP were for an 18-month period. The Agreement with this Contractor is one of several that was approved for these services.

 

Behavioral Health and Recovery Services (BHRS) receives an annual Bay Area Services Network (BASN) allocation for Alcohol and Other Drug (AOD) treatment services through the State Net Negotiated Agreement (NNA). Although funding was initially allocated for Horizon Services, Inc., those funds have not been utilized, and will be re-allocated through separate amendments with other providers. On December 4, 2007, your Board approved an Agreement with Horizon Services, Inc., to furnish alcohol and drug services funded through NNA, for the term January 1, 2008 through June 30, 2009, for a maximum obligation of $897,708. On February 28, 2008, the Agreement was amended to incorporate BASN funds in the amount of $10,500, and add a cost of living increase for a new maximum of $926,162.

 

DISCUSSION:

AOD has had separate Agreements with this provider for each major program area and/or funding source. In order to consolidate those multiple Agreements into one Agreement, BHRS is amending this NNA funded Agreement to add services funded through Proposition 36 (P36), Substance Abuse and Crime Prevention Act (SACPA), and Senate Bill 223 (SB223) services. The term is being extended through FY 2009-10. Services funded for SACPA, SACPA Offender Treatment Program (OTP), and SB223 have aggregate maximum amounts which are shared by all contractors providing these services.

 

The amended Agreement has been reviewed and approved by County Counsel and Risk Management. The Contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination, and equal benefits.

 

FISCAL IMPACT:

The term for this amended Agreement is January 1, 2008 to June 30, 2010. The Agreement’s maximum obligation is being increased by $2,099,112, for a new maximum of $3,025,274. The maximum obligation for FY 2008-09 is increased from $626,926 to $2,059,612. Of that amount, NNA will fund $666,426. The remaining $1,393,186 will be funded by SACPA, SACPA OTP, and SB223 allocations, which is an aggregate amount shared by all contractors that provide the same or similar services.

The amounts for FY 2009-10 have been included in the BHRS FY 2009-10 Recommended Budget. The Net County Cost for FY 2008-09 is $32,758, the County match requirement to obtain SACPA OTP funds. The anticipated Net County Cost for FY 2009-10 is $32,758.
