Lease Agreement with the Federal Aviation Administration for the operation of a VORTAC facility at Wunderlich County Park, Woodside. (Lease No. 5012)

RECOMMENDATION:
|
Adopt a resolution:
1. Authorizing and directing the President of the Board of Supervisors to execute a Lease Agreement with the Federal Aviation Administration, for the operation of a VORTAC facility at Wunderlich County Park, Woodside, at a rate of $11,500 per year, for a term of ten years, and
2. Authorizing the County Manager or his designee to execute notices, options and documents associated with the Agreement including, but not limited to, extension or termination of the Agreement under the terms set forth therein.

The Agreement contributes to this commitment and goal by generating revenue to the County while allowing the FAA to continue operating the VORTAC facility, which is utilized by pilots as a navigation and approach aid, assisting them in conducting safe and efficient flights and landings.

BACKGROUND:
|
In 1974, Wunderlich Park was donated to the County for use as a public park and open space. The Federal Aviation Administration (“FAA”) had an agreement with the previous owner which allowed them to operate a Very High Frequency Omnirange Tactical Air Navigation facility (“VORTAC”) on a portion of the park. In 1975, that lease expired and the County and FAA entered into the first of a series of one-year agreements for the operation of the VORTAC. In 1998, the County and FAA entered into a ten-year agreement, which expired in 2008, and the FAA has continued operating the site on a month-to-month basis in accordance with the holdover provision of the Agreement. The FAA wishes to enter into a new long-term agreement for the site.

DISCUSSION:
|
Real Property Services has negotiated an agreement for a term of ten years, at an annual fee of $11,500. There are no changes to the use of the facility as a result of this agreement.
|

County Counsel has reviewed and approved the Lease Agreement as to form. The Director of Parks concurs in this recommendation.

FISCAL IMPACT:
|
The annual fee, totaling $115,000 for the 10-year term, will be deposited into the Revenue Account for the Department of Parks.
