Capital Fund Stimulus Grant Procurement Policy Amendment for the Housing Authority of the County of San Mateo

 

RECOMMENDATION:

Adopt Resolution No. 2009-06 amending the Housing Authority of the County of San Mateo’s (HACSM’s) Capital Fund Stimulus Grant Procurement Policy.

BACKGROUND:

The Board of Supervisors, sitting as the Board of Commissioners of the Housing Authority, approved the HACSM’s procurement policy by Resolution No. 642-C on December 18, 2007. On March 11, 2009, your Board adopted a Resolution authorizing the acceptance and use of American Recovery and Reinvestment Act (ARRA) Capital Grant Funds. HACSM was awarded $366,511 from ARRA for Capital Fund Formula Grants for its public housing. As a result, HACSM executed the Capital Fund Program Amendment to the Consolidated Annual Contributions Contract with HUD.

Guidance provided in the U.S. Department of Housing and Urban Development (HUD) Notice PIH 2009-21(HA) provides the procurement requirements for receipt of ARRA grant funds, including but not limited to prioritizing Capital Fund Stimulus Grant projects awarded on bids within 120 days from February 17, 2009, and exempting Capital Fund Stimulus Grants from state and local procurement requirements, which accordingly necessitates that HACSM amend its procurement policy to bring it into conformance with these requirements.

In a Resolution adopted May 19, 2009, the Board of Supervisors delegated authority to the County Manager to facilitate County of San Mateo’s receipt and expenditure of federal economic stimulus funds. On its face, that Resolution does not appear to delegate authority on behalf of the Board of Commissioners of the Housing Authority of the County of San Mateo to the County Manager, and therefore HACSM submits this Resolution 2009-06.

DISCUSSION:

In accordance with the HUD Notice PIH 2009-21(HA), HACSM created an amendment to its current procurement policy in order to expedite and facilitate the use of ARRA capital funds. This amended policy is to be used only for procurements under the ARRA Capital Fund Stimulus Grant.

General provisions of the amended policy include, but are not limited to, the following:

    § HACSM shall give priority to Capital Fund Stimulus Grant projects that can be awarded based on bids within 120 days from February 17, 2009.

    § Any requirements relating to the procurement of goods and services arising under state and local laws and regulations shall not apply to Capital Fund Stimulus Grants. HACSM shall follow the Code of Federal Regulations Title 24, Part 85 requirements.

County Counsel has reviewed and approved the Resolution as to form.

FISCAL IMPACT:

There is no Net County Cost associated with this action.
