Fourth Amendment to the Agreement with the State Department of Alcohol and Drug Programs (State Agreement # 07-NNA41)

 

Recommendation

Adopt a Resolution Authorizing a Fourth Amendment to a Revenue Agreement with the State Department of Alcohol and Drug Programs increasing the appropriation of funds for alcohol and other drug services by $80,778, to a new maximum amount of $18,489,837, with no change to the term of July 1, 2007 through June 30, 2010.

This Agreement contributes to this commitment and goal by providing funding for alcohol and drug treatment services.

 

Behavioral Health and Recovery Services (BHRS) provides a range of services to promote wellness and recovery and to support clients to maintain abstinence and sobriety.  The provision of funding for substance abuse treatment services provided through this Agreement contributes to this measure.

Background

On May 22, 2007, your Board approved a three-year Negotiated Net Amount Drug Medi-Cal (NNA/DMC) Revenue Agreement with the State Department of Alcohol and Drug Programs (AODP) for the distribution of the federal Substance Abuse Prevention and Treatment (SAPT) block grant funds. Funding for Drug Medi-Cal is included in the Agreement. The term of that Revenue Agreement is July 1, 2007 through June 30, 2010, with a maximum obligation, at the time of approval, of $18,427,857. Your Board also granted the then Director of Health authority to execute contract amendments up to an aggregate amount of $25,000.

 

Occasionally, the State AODP provides additional funds or requires cuts in the funding through State amendments to the NNA/DMC. On April 8, 2008, under a First Amendment approved by the Director of Health, the funding was reduced by $651 to a revised maximum of $18,427,206. On August 14, 2008, under a Second Amendment approved by the Director of Health, funding was adjusted between service areas, with no change to the Agreement maximum. On February 26, 2009, the Chief of the Health System approved a Third Amendment, reducing the maximum by $18,147, to a revised maximum of $18,409,059.

 

Discussion

This County Fourth Amendment (State’s Second Amendment for FY 2008-09) increases the maximum funding for Drug Medi-Cal by $80,778 for FY 2008-09; This reflects an increase in the Federal Financial Participation share to 61.59% and a corresponding decrease of State General Fund share to 38.41%, effective October 1, 2008.

 

County Counsel has reviewed and approved this Amendment.

 

Fiscal Impact

The term of this Agreement remains July 1, 2007 through June 30, 2010. The maximum funding received from this Agreement is $18,489,837. Funding for the term of the Agreement is as follows:

    FY 2007-08 $ 6,141,968

    FY 2008-09 $ 6,205,250

    FY 2009-10 $ 6,142,619

    Total Funding $18,489,837

 

Funding for Fiscal Year 2008-09 has been included in the BHRS FY 2008-09 Adopted Budget. Funding for FY 2009-10 is included in the BHRS FY 2009-10 Recommended Budget. There is no Net County Cost.
