RECOMMENDATION:

Adopt a Resolution:

1) Authorizing the President of the Board to execute an Agreement with Mental Health Association of Alameda County for the provision of patients’ rights services for the term July 1, 2009 through June 30, 2012, for a maximum amount of $599,136; and

 

2) Authorizing the Chief of the Health System or designee to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

The Agreement contributes to this commitment and this goal by providing patients’ rights advocacy services for individuals receiving inpatient mental health services in San Mateo County.

BACKGROUND:

By statute the County is obligated to provide patients’ rights advocacy services for all recipients of mental health services in San Mateo County. These services include patient hearing representation at Certification and Capacity Hearings in psychiatric inpatient facilities, as well as complaint investigation and resolution, monitoring of mental health facilities, and outreach and training on advocacy topics for clients and providers. There are four inpatient facilities in the County where Capacity and Certification Hearings take place: Mills-Peninsula Hospital, San Mateo Medical Center (SMMC), Sequoia Hospital, and the Veteran’s Administration in Menlo Park.

 

In December 2008 Behavioral Health and Recovery Services (BHRS) released a Request for Proposals (RFP) in order to select a provider of patients’ rights advocacy services. The Mental Health Association of Alameda County (MHA) was the only respondent to the RFP and was subsequently selected to provide those services. MHA has provided these services for BHRS continuously since 2003.

 

DISCUSSION:

The Agreement with this Contractor is for a three-year term. Contractor will provide patients’ rights advocacy services for all recipients of mental health services in San Mateo County. As required by statute, services will be provided to all County residents receiving mental health services whether or not they are receiving services through Behavioral Health and Recovery Services. Patients’ rights advocacy services include: complaint investigation and resolution; compliance monitoring of facilities providing mental health services; training of staff in mental health facilities regarding patients’ rights, laws, regulations and policies; patient education services to comply with State requirements for advance directives; and patient representation at Certification Hearings and Capacity Hearings at Sequoia Hospital, the Veteran’s Administration in Menlo Park, Mills-Peninsula Hospitals and San Mateo Medical Center. The contractor will provide services through an office in San Mateo County.

 

The Agreement has been reviewed and approved by County Counsel and Risk Management. The contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

FISCAL IMPACT:

The term of the Agreement is July 1, 2009 through June 30, 2012. The Agreement maximum is $599,136. For FY 2009-10 the maximum is $199,712. Services will be funded 100% by sales tax through realignment. These funds have been included in the BHRS FY 2009-10 Recommended Budget. There is no Net County Cost. Similar budget arrangements will be made for subsequent years.
