RESOLUTION 1) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH THE HILLER AVIATION MUSEUM WHICH ALLOWS HILLER TO HOLD A DINNER SHOW ON FRIDAY, JUNE 19, 2009, CONDUCT A HELICOPTER AIR SHOW, ON SATURDAY, JUNE 20, 2009, AND HAVE A DISPLAY OF MILITARY AIRCRAFT ON SUNDAY, JUNE 21, 2009, AT THE SAN CARLOS AIRPORT; AND 2) AUTHORIZING A ONE-TIME WAIVER OF THE 12,500-POUND WEIGHT RESTRICTION AT THE SAN CARLOS AIRPORT FOR THE SPECIFIED DISPLAY AIRCRAFT AS SET FORTH IN THE AGREEMENT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, California Government Code Section 25536 allows a county, by four-fifths (4/5ths) vote of its Board of Supervisors, to enter into agreements to permit activities on land held by the county for airport purposes; and

WHEREAS, the Hiller Aviation Museum (Hiller) has requested the use of the San Carlos Airport's runway, taxiways and other public facilities, services and conveniences for their event called the Vertical Challenge Helicopter Air Show (Air Show); and

WHEREAS, a one-time waiver of the 12,500-pound weight restriction at the San Carlos Airport for the specified display aircraft has been recommended; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, an agreement between the County of San Mateo and Hiller, which allows Hiller to conduct the Air Show from Friday, June 19, 2009, through Sunday, June 21, 2009; reference to which is hereby made for further particulars (the “Agreement”), and the Board of Supervisors has examined and approved the Agreement as to form and content and desires to enter into the Agreement.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board be, and is hereby, authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the signature of the Clerk of this Board shall attest thereto.

IT IS HEREBY FURTHER DETERMINED AND ORDERED that this Board authorizes a one-time waiver of the 12,500-pound weight restriction at the San Carlos Airport for the specified display aircraft as set forth in the Agreement whose execution is authorized by this resolution.
