Setting a Hearing Date for the Adoption of the Garbage and Recyclables Collection Service Charges Report in County Service Area No. 8 (North Fair Oaks Area) for Fiscal Year 2009-10

 

RECOMMENDATION:

Acting as the governing board of County Service Area No. 8, adopt a resolution setting July 14, 2009 at 9:15 a.m. at your regularly scheduled Board meeting, as the time and place for a public hearing on the filing of the Garbage and Recyclables Collection Service Charges Report for County Service Area No. 8 (North Fair Oaks) for Fiscal Year 2009-10.

Setting the Public Hearing for the Fiscal Year (FY) 2009-10 Garbage and Recyclables Collection Service Charges Report will allow the County to collect fees for services for the continued provision of garbage and recycling collection in the North Fair Oaks Area.

 

BACKGROUND:

PREVIOUS BOARD ACTION:

On April 28, 2009, your Board set June 16, 2009 at 9:15am as the time and date for a public hearing, on the adoption of the proposed garbage and recyclables collection rates in County Service Area No. 8 (North Fair Oaks) for FY 2009-10 and FY 2010-11. At the close of the public hearing on June 16, 2009 the Board will adopt garbage and recyclables collection rates, which will be used to prepare the FY 2009-10 Garbage and Recyclables Collection Service Charges Report (Charges Report).

 

HISTORY:

County Service Area No. 8 provides garbage and recyclables collection services in the North Fair Oaks area through a franchise agreement with the contractor (currently Republic Services and formerly Allied Waste Services). The County generates the revenue to pay the contractor by charging fees based on pick-up units for each affected parcel that meets the criteria outlined in County Ordinance Code 4.04.180. These fees are defined and adopted each fiscal year in the Charges Report and placed on the tax roll. All other commercial and industrial properties that are not placed on the County tax roll are billed directly by Republic Services.

 

Adoption of the Charges Report for FY 2009-10 and its filing with the Clerk of the Board will result in the user charges contained therein being placed on the tax roll. These charges will appear on the FY 2009-10 tax bill of each affected property and will be collected in the same manner as the property taxes.

 

The County Ordinance Code requires your Board to hold a public hearing to consider public testimony prior to adopting the Charges Report. The recommended action, adopting a resolution setting the time and place for the public hearing is the first step in the process and is procedural. After the close of the public hearing, the Board may adopt the individual charges as presented, or revise, change, reduce or modify any charge in the report.

 

A resolution has been approved as to form by County Counsel.

 

FISCAL IMPACT:

There is no fiscal impact associated with the recommended action of setting a public hearing.
