Setting a Hearing Date to Consider the Sewer Service Charges Report for Fiscal Year 2009-2010 for the Ten County Sewer/Sanitation Districts Governed by the Board of Supervisors

RECOMMENDATION:
|
Acting as the governing board of the ten County Sewer/Sanitation Districts, adopt a resolution setting Tuesday, July 14, 2009, at 9:30 a.m. at your regularly scheduled Board meeting, as the time and place for a public hearing on the filing of the Sewer Service Charges Report for Fiscal Year 2009-2010 for the ten County Sewer Maintenance and Sanitation Districts (Districts) based on the Sewer Service Rates set for Fiscal Year 2009-2010.

Your Board authorizing a public hearing to consider the FY 2009-2010 Sewer Service Charges Report can result in the financing of sanitary sewer service in the Districts that serve portions of the unincorporated area and some neighboring city areas.

BACKGROUND
|
Sewer service charges are collected on the property tax bill. The charges are based on sewer service rates approved by your Board.
|

Previous Board Action
|
Your Board adopted five-year rates for eight districts in 2007. However, property owners from the Crystal Springs County Sanitation District (CSCSD) and Burlingame Hills Sewer Maintenance District (BHSMD) presented majority protests in 2006 and 2007, respectively, which led to the inability to raise rates. Your Board has since been setting yearly rates for the CSCSD and BHSMD and staff has been working with a group of representatives from the BHSMD and the CSCSD to explore long-term solutions and develop rates on a year-to-year basis.

Your Board adopted Ordinance No. 04466 on April 28, 2009, establishing the sewer service rates for the FY 2009-2010 for the BHSMD and the CSCSD.

HISTORY
|
Acting as the governing board of the Districts, your Board adopted similar resolutions in the past setting the time and date of a public hearing to consider the annual Sewer Service Charges Report for the Districts.

DISCUSSION
|
The Districts governed by your Board serve approximately 12,200 properties and finance the operation and maintenance of approximately 150 miles of sewer mains as well as the cost of treating the sewage collected by the Districts. Virtually all of the revenue to provide these services in each district is generated by the sewer service charges that are levied on the property owner’s tax bill. The FY 2009-2010 Sewer Service Charges Report, which is being prepared concurrently with this report, contains the individual charge for each parcel of real property receiving sewer service from each of the ten (10) districts.

The recommended action, adopting a resolution setting the time and place for the public hearing, is the first step in the process and is procedural.
|

A resolution has been approved as to form by County Counsel.
|

FISCAL IMPACT:
|
There is no fiscal impact by setting the public hearing. However, levying the individual sewer service charge, which can occur after the public hearing, will result in charges being levied on those parcels receiving sewer service. The approved rates for FY 2009-2010 for each equivalent residential unit are:

There is no direct impact to the General Fund. However, sewer service charges are levied on property that is either leased or owned by the County where sewer service is provided.
