ACTING AS THE GOVERNING BOARD OF COUNTY SERVICE AREA NO. 8

ADOPTING THE GARBAGE AND RECYCLABLES COLLECTION RATES FOR COUNTY SERVICE AREA NO. 8 (NORTH FAIR OAKS) FOR THE 2009-10 AND 2010-11 YEARS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, as the governing board of County Service Area No. 8, that

 

WHEREAS, the Director of Public Works of San Mateo County has recommended garbage and recyclables collection rates for the 2009-10 (Exhibit “A”) and 2010-11 years (Exhibit “B”) for County Service Area No. 8; and

 

WHEREAS, Proposition 218 requires an individual notice of the hearing to consider any new or increased property related fees including garbage collection charges, and a mechanism for rejecting fees via a majority protest at a public hearing; and

 

WHEREAS, the Director of Public Works of San Mateo County has caused such notices to be given to each property owner within County Service Area No. 8 in accordance with the requirements of Proposition 218; and

 

WHEREAS, this Board heard and considered all protests and objections to said garbage and recyclables collection rates, has determined that a majority protest does not exist, and has determined that said rates should be adopted:

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED THAT:

 

effective July 1, 2009 the garbage and recyclables collection rate schedule for services provided pursuant to the Franchise Agreement for County Service Area No. 8, are as set forth in Exhibit “A” to this resolution, which is attached hereto and incorporated by reference.

 

IT IS FURTHER DETERMINED AND ORDERED THAT:

effective January 1, 2010 the garbage and recyclables collection rate schedule for services provided pursuant to the Franchise Agreement for County Service Area No. 8 are as set forth in Exhibit “B” to this resolution, which is attached hereto and incorporated by reference for commercial properties, dwelling units receiving new garbage and recyclables service not previously levied on their tax bill, or properties that receive garbage service above the minimum level set by Ordinance. The rates as set forth in Exhibit “B” will be applied in the 2010-2011 year to the minimum level of service properties as defined in County Ordinance Code 4.04.180 “Rates” and charged on the property tax bill in accordance with County Ordinance Code 4.04.290 “Tax Bill”.
