IN-HOME SUPPORTIVE SERVICES PUBLIC AUTHORITY,
COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION UNILATERALLY IMPLEMENTING THE LAST, BEST AND FINAL OFFER TO CONTRIBUTE $2.15 PER HOUR FOR IN-HOME SUPPORTIVE SERVICES PROVIDER WAGES REGARDLESS OF FEDERAL AND STATE PARTICIPATION LEVELS FOR ONE YEAR

RESOLVED, by the In-Home Supportive Services Public Authority of the County of San Mateo, State of California, that

 

WHEREAS, the Board of Supervisors of San Mateo County has designated itself as the Governing Board of the San Mateo County In-Home Supportive Services Public Authority (the “Public Authority”) to carry out programs pursuant to the In-Home Supportive Services (IHSS) program; and

 

WHEREAS, the Governing Board of the PA is committed to participating in the Independent Provider wage at the highest rate at which the State participates; and

 

WHEREAS, the State of California enacted California Welfare and Institutions Code section 12306.1(d)(6) which reduced the State participation rate from $11.50 to $9.50 effective July 1, 2009; and

 

WHEREAS, although the State has been preliminarily enjoined from and restrained from implementing California Welfare and Institutions Code section 12306.1(d)(6), it remains unclear whether State and Federal participation levels will remain at FY 2008-09 levels for the duration of FY 2009-10; and

 

WHEREAS, beginning in February 2009, the Public Authority has made several attempts to hold negotiations with Service Employees International Union, Local 521 (SEIU); and

 

WHEREAS, on June 9, 2009, the Public Authority issued its last, best and final offer to contribute $2.15 per hour regardless of Federal and State participation levels to SEIU with a request to respond by June 12, 2009, and SEIU failed to respond; and

 

WHEREAS, on June 18, 2009, the Public Authority sent a request to SEIU for an impasse meeting with a request to respond by June 23, 2009, and SEIU failed to respond; and

 

WHEREAS, on June 25, 2009, the Public Authority sent a request to SEIU to engage in mediation, fact-finding, or another form of impasse resolution, with a request to respond by July 3, 2009, and SEIU failed to respond.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that, this Board of Supervisors, as the Governing Board of the San Mateo County IHSS Public Authority, hereby authorizes the unilateral implementation of the Public Authority’s last, best and final offer to contribute $2.15 per hour for IHSS provider wages regardless of Federal and State participation levels for one year.
