RESOLUTION 1) WAIVING THE REQUEST FOR PROPOSAL PROCESS; AND 2) AUTHORIZING THE COUNTY PURCHASING AGENT TO ISSUE A PURCHASE ORDER TO ACCUVANT, INC. TO PROVIDE A PERPETUAL LICENSE FOR A BIGFIX SYSTEM LIFECYCLE MANAGEMENT PLATFORM AND ASSOCIATED SUPPORT, FOR THE TERM AUGUST 25, 2009, TO AUGUST 24, 2012, WITH A TOTAL FISCAL OBLIGATION NOT TO EXCEED $348,000.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, in 2004, the County purchased a subscription for a Patch Management System—known as “BigFix,” purchased from Accuvant, Inc.—to facilitate fighting any virus outbreaks in the future. A perpetual license for BigFix, Inc.’s full System Lifecycle Management Platform product suite will allow the County to lower ongoing costs and continue to benefit from the substantial investment in training and labor expended to distribute and install the product;

WHEREAS, this Board has determined it to be in the best interest of the County to authorize the waiver of the Request for Proposals process;

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a request to authorize the County Purchasing Agent to issue a purchase order to Accuvant, Inc. for a System Lifecycle Management platform perpetual license and, for the term August 25, 2009, to August 24, 2012, support with a total fiscal obligation not to exceed $348,000.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Request for Proposal process is waived, the County Purchasing Agent is authorized to issue a purchase order to Accuvant, Inc. for a BigFix System Lifecycle Management Platform perpetual license and associated support, for the term August 25, 2009, to August 24, 2012, in an amount not to exceed $348,000, and the President of the Board of Supervisors is authorized and directed to execute this Resolution as is approved by the County Counsel for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature hereto.
