RESOLUTION 1) AWARDING AND AUTHORIZING EXECUTION OF A CONTRACT WITH HSR, GENERAL ENGINEERING CONTRACTORS, INC., DBA HSR, INC., IN THE AMOUNT OF $720,173.00 FOR THE COYOTE POINT BAY TRAIL IMPROVEMENT PROJECT AT THE COYOTE POINT RECREATION AREA (PROJECT NO. P14F1, F-36 [315D]); AND 2) AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE CONTRACT CHANGE ORDERS IN AN AMOUNT NOT TO EXCEED $108,025 OR APPROXIMATELY 15% OF THE CONTRACT AMOUNT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on December 16, 2008, adopt Resolution No. 069854, which resolution adopted the plans and specifications (the “Plans and Specifications”), including conformance with prevailing wage rates scale requirements, and called for sealed proposals for the Coyote Point Bay Trail Improvement Project at the Coyote Point Recreation Area; and

WHEREAS the Clerk of this Board of Supervisors did, in public on January 13, 2009, open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 069854; and

WHEREAS the County has requested and the Contractor has agreed to, in writing, an extension of the period to award the contract to August 25, 2009; and

WHEREAS, this Board of Supervisors has caused an analysis of said proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said sealed proposals and the analysis thereof; and

WHEREAS, the lowest responsible bid was submitted by HSR, General Engineering Contractors, Inc. DBA HSR, Inc., in the amount of Seven Hundred Twenty Thousand One Hundred Seventy-Three and No/100 Dollars ($720,173.00) based on an estimate of the amount of work to be done.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

It is in the best interest of the County of San Mateo to award the contract for the Coyote Point Bay Trail Improvement Project at the Coyote Point Recreation Area to:

HSR, General Engineering Contractors, Inc.

dba HSR, Inc.

530 Aldo Avenue

Santa Clara, CA 95054

2.

The County of San Mateo shall enter into a written agreement with HSR, Inc., for the doing of said work as required by the Plans and Specifications therefore adopted and approved by this Board of Supervisors, as hereinbefore mentioned, said Plans and Specifications being on file in the office of the Director of Public Works of the County of San Mateo.

That the President of this Board of Supervisors shall be, and is hereby, authorized and directed, for and on behalf of the County of San Mateo, to enter into said written contract with HSR, Inc. for the doing of said work, as hereinbefore mentioned and to receive and approve the Faithful Performance Surety Bond and the Payment Bond required to be posted by said Contractor with the County of San Mateo in connection therewith.

That all payments to the Contractor shall be in accordance with the plans, specifications, and other contract documents, based on the Director of Public Works' written estimates of work actually done.

Paragraph 4 above notwithstanding, the Director of Public Works is authorized to execute Contract Change Orders in an amount not to exceed One Hundred Eight Thousand Twenty-Five and No/100 Dollars ($108,025.00) without this Board’s approval.

Paragraph 4 above notwithstanding, aggregate payments to Contractor shall not exceed the sum of Eight Hundred Twenty-Eight Thousand One Hundred Ninety-Eight and No/100 Dollars ($828,198.00) without this Board's approval.

7.

The Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
