RESOLUTION 1)  AWARDING AND AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE A CONTRACT WITH RODAN BUILDERS, INC. IN THE AMOUNT OF $965,750.00 FOR THE SAN MATEO MEDICAL CENTER, RON ROBINSON SENIOR CARE CENTER PROJECT; AND 2)  AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE CONTRACT CHANGE ORDER UP TO A MAXIMUM AGGREGRATE AMOUNT OF $144,860.00, OR APPROXIMATELY 15% OF THE CONTRACT AMOUNT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the Board of Supervisors did, on April 28, 2009, adopt Resolution No. 070072, which Resolution adopted the plans and specifications (the “Plans and Specifications”), including conformance with prevailing wage requirements, and called for sealed bids for the San Mateo Medical Center, Ron Robinson Senior Care Center Project, San Mateo and

WHEREAS, the Clerk of this Board of Supervisors did, in public on June 2, 2009 at 2:30 p.m., open and examine all sealed bids that were received in the specified time for doing of the work referred to in said Resolution No. 070072; and

WHEREAS, this Board of Supervisors has caused an analysis of said bids to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said sealed bids and the analysis thereof; and

WHEREAS, the lowest responsible bid was submitted by Rodan Builders, Inc., in the amount of Nine Hundred Sixty-Five Thousand Seven Hundred Fifty dollars ($965,750.00) based on the estimate of the amount of the work to be done; and

WHEREAS, although two lower bids were submitted, per the attached Exhibit A, the lowest bidder withdrew his bid, and the next lowest bid did not meet the requirement of special experience and expertise the area of hospital construction, and therefore, the Department of Public Works has recommended rejection of that bid.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

1.

It is in the best interest of the County of San Mateo to award the contract for the San Mateo Medical Center, Ron Robinson Senior Care Center Project to:

Rodan Builders, Inc.

Burlingame, CA 94010

The bid of the contractor who, per Exhibit A, submitted a lower bid that did not document compliance with the requirement of OSHPD experience is hereby rejected.

2.

The County of San Mateo shall enter into a written contract with Rodan Builders, Inc. for completion of said work as required by the Plans and Specifications adopted by this Board of Supervisors, as hereinbefore mentioned, which Plan and Specifications are on file in the office of the Director of Public Works of the County of San Mateo.

On behalf of the County of San Mateo, the President of this Board of Supervisors shall be, and is hereby, authorized and directed to enter into an agreement with Rodan Builders, Inc. for the doing of said work described herein, subject to the department of Public Works receipt and approval of the Faithful Performance Surety Bond (“Performance Bond”) and the Labor and Material Surety Bond (“Payment Bond”) required to be posted by said Contractor with the County of San Mateo in connection therewith.

The Director of Public Works is hereby authorized to execute contract change orders related to the said work not exceeding One Hundred Forty-Four Thousand Eight Hundred Sixty and No/100 Dollars ($144,860.00) in aggregate.

All payments to the Contractor shall be in accordance with the Plans and Specifications, and other contract documents. Aggregate payments to the Contractor shall not exceed Nine Hundred Sixty-Five Thousand Seven Hundred Fifty and No/100 Dollars ($965,750.00) without this Board’s approval.

6.

The Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
