RESOLUTION FOR THE 2009 RESURFACING OF VARIOUS STREETS IN UNINCORPORATED AREAS OF SAN MATEO COUNTY (PROJECT NO. RT201, FILE NO. F-36 [403]; FEDERAL-AID PROJECT NO. ESPL-5935[054]]) 1) ADOPTING PLANS AND SPECIFICATIONS, DATED MAY 12, 2009, INCLUDING CONFORMANCE WITH PREVAILING WAGE SCALE REQUIREMENTS; 2) AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO FILE A NOTICE OF EXEMPTION FOR A CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) CATEGORICAL EXEMPTION; 3) AWARDING AND AUTHORIZING EXECUTION OF A CONTRACT WITH PAVEX CONSTRUCTION, IN THE AMOUNT OF $1,691,366 FOR WORK LISTED IN SCHEDULE(S) A+B+C+D; AND

4) AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO ISSUE CONTRACT CHANGE ORDERS UP TO A MAXIMUM AGGREGATE AMOUNT OF $169,136, OR APPROXIMATELY 10% OF THE CONTRACT AMOUNT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, this Board of Supervisors did, on February 10, 2009, adopt Resolution No. 069928, which resolution authorized the Director of Public Works to prepare plans and specifications, including conformance with prevailing wage scale requirements, and call for sealed proposals for the construction of the 2009 Resurfacing of Various Streets in Unincorporated San Mateo County (Project) funded through the Federal Government’s American Recovery and Reinvestment Act of 2009, hereinafter referred to as ARRA; and

 

WHEREAS, this Board of Supervisors did, on March 17, 2009, adopt Resolution No. 069987, which resolution authorized the Director of Public Works to file an application for ARRA funding to finance the Project; and

 

WHEREAS, this Board of Supervisors did, on June 19, 2001, adopt Resolution No. 64550, which resolution authorized the Director of Public Works to execute agreements with utility agencies for utility type work costing less than $50,000 proposed to be done in conjunction with road projects; and

 

WHEREAS, the project qualifies for a Categorical Exemption pursuant to Section 15301(c) of the CEQA Guidelines for Implementation because the work consists of repair and maintenance of existing streets or highways.

 

WHEREAS, the Clerk of this Board of Supervisors did, in public on August 4, 2009 at 2:30 p.m., open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 069928; and

 

WHEREAS, this Board of Supervisors has caused an analysis of said proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said sealed proposals and the analysis thereof; and

 

WHEREAS, the lowest responsible bid was submitted by Pavex Construction, in the amount of One Million Six Hundred Ninety-One Thousand Three Hundred Sixty-Six Dollars ($1,691,366) based on an estimate of the amount of work to be done for Schedule(s) A+B+C+D.

 

    NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

 

1.

The plans and specifications dated May 12, 2009 for the aforesaid project are hereby approved and are adopted as the plans and specifications to be adhered to in letting and performing the work under a contract for said improvements.

   

2.

The Director of Public Works is hereby directed to file a Notice of Exemption for a CEQA Categorical Exemption for the 2009 Resurfacing of Various Streets in Unincorporated Areas of San Mateo County Project.

   

3.

It is to the best interest of the County of San Mateo to award the contract for the construction of the 2009 Resurfacing of Various Streets in Unincorporated Areas of San Mateo County Project to:

 

Pavex Construction

120 Granite Rock Way

San Jose, CA 95136

 

4.

The County of San Mateo shall enter into a written agreement with Pavex Construction, for the completion of said work as required by the Plans and Specifications, as hereinbefore mentioned, which Plans and Specifications are on file in the office of the Director of Public Works of the County of San Mateo.

   

5.

On behalf of the County of San Mateo, the President of this Board of Supervisors shall be, and is hereby, authorized and directed to enter into an agreement with Pavex Construction, for the doing of said work described herein, subject to the Department of Public Works’ receipt and approval of the Faithful Performance Surety Bond and the Payment Bond required to be posted by said Contractor with the County of San Mateo in connection therewith.

   

6.

All payments to the Contractor shall be in accordance with the Plans, Specifications, and other contract documents, based on the Director of Public Works' written estimates of work actually done.

   

7.

Paragraph 6 above notwithstanding, aggregate payments to Contractor shall not exceed the sum of One Million Eight Hundred Sixty Thousand Five Hundred and Two Dollars ($1,860,502) without this Board's approval.

   

8.

That the Public Works Director is hereby authorized to execute change orders in an amount not to exceed $169,136 or approximately 10% of the contract amount, which is included in the amount specified in Paragraph 7 above.

   

9.

The Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
