RESOLUTION AUTHORIZING AND DIRECTING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE A THIRD AMENDMENT TO THE RESIDENTIAL RENTAL AGREEMENT WITH JEROME W. AND KAREN MERTENS FOR THE SHERIFF'S COMMUTER HOUSE AT 731 VALOTA RD, REDWOOD CITY,

WHICH EXTENDS THE EXPIRATION DATE TO AUGUST 31, 2012 WITH TWO OPTIONS TO EXTEND FOR ONE ADDITIONAL YEAR EACH, AT AN INITIAL MONTHLY RATE OF $3,700; AND AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO EXECUTE NOTICES, OPTIONS AND DOCUMENTS ASSOCIATED WITH THE THIRD AMENDMENT AND AGREEMENT INCLUDING, BUT NOT LIMITED TO, EXTENSION OR TERMINATION OF THE AGREEMENT UNDER THE TERMS SET FORTH THEREIN. (LEASE NO. 1252)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on September 11, 2001, the County of San Mateo and Jerome W. and Karen Mertens, as authorized by Resolution No. 64723, entered into a Residential Rental Agreement for the property located at 731 Valota Road, Redwood City, California; and

WHEREAS, on September 10, 2002, the County and the Landlord, as authorized by Resolution No. 65531, entered into a First Amendment, which Amendment extended the term; and

WHEREAS, on August 15, 2006, the County and the Landlord, as authorized by Resolution No. 68207, entered into a Second Amendment, which Amendment further extended the term and modified the base rent; and

 

WHEREAS, the Lease expired on August 31, 2009, and the parties wish to further amend the Rental Agreement to extend the term through August 31, 2012, with two options to extend for one year each, at an initial monthly rent of $3,700, which rent will increase annually based on the Consumer Price Index, and otherwise on the same terms and conditions; and

 

WHEREAS, this Board has been presented with the Third Amendment to Residential Rental Agreement and has examined and approved same as to both form and content and desires to enter into same.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute such Third Amendment to Residential Rental Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to accept or execute on behalf of the County, any and all notices, options and documents associated with the Third Amendment and Agreement including, but not limited to, extension or termination of the Agreement under the terms set forth therein.
