BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION 1) WAIVING FURTHER COMPETITIVE BIDDING; 2) APPROVING AN AGREEMENT WITH LA HONDA VOLUNTEER FIRE BRIGADE WHICH SETS FORTH THE TERMS FOR FUNDING AND PURCHASE OF A REPLACEMENT RESCUE VEHICLE, INCLUDING A PAYMENT SCHEDULE FOR THE LA HONDA VOLUNTEER FIRE BRIGADE TO PAY A PORTION OF ITS CONTRIBUTION TO THE FUNDING OF THE VEHICLE IN THE AMOUNT OF $18,622; AND 3) AUTHORIZING THE PURCHASING AGENT TO ISSUE A PURCHASE ORDER FOR A REPLACEMENT RESCUE VEHICLE FOR THE LA HONDA VOLUNTEER FIRE BRIGADE IN THE AMOUNT OF $174,744 THAT WILL BE PARTIALLY REIMBURSABLE THROUGH AN OFFICE OF TRAFFIC SAFETY (OTS) GRANT RECEIVED BY COUNTY FIRE IN 2008

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the California Department of Fire (CalFire) was awarded a grant from the Office of Traffic Safety of $310,457 in September of 2008 that, in part, specified the purchase of a replacement rescue vehicle for the La Honda Volunteer Fire Brigade, and

WHEREAS, the County of San Mateo and the Mid-Peninsula Open Space District would also contribute to the purchase of the rescue vehicle, and

WHEREAS, the County of San Mateo would purchase the extrication equipment on behalf of CalFire and the La Honda Volunteer Fire Brigade, and

WHEREAS, the La Honda Volunteer Fire Brigade has requested the County contribute $18,622 to partially cover its funding commitment to the vehicle, that the La Honda Volunteer Fire Brigade would pay to the County over a seven year period during which time the vehicle would be solely owned by the County of San Mateo, and

WHEREAS, once the full $18,622 has been paid to the County of San Mateo, the vehicle would be co-owned by the County of San Mateo and the La Honda Volunteer Fire Brigade, and

WHEREAS, the La Honda Volunteer Fire Brigade has conducted an adequate competitive bid process for purchase of the replacement rescue vehicle; and

WHEREAS, San Mateo County Ordinance Code section 2.83.050 provides that the Board of Supervisors may waive any of the competitive bidding procedures required by the ordinance in any situation where the Board of Supervisors determines that the best interests of the County would be served without the necessity of competitive bidding, and

WHEREAS, it is in the best interests of the County to waive any further competitive bidding conducted by the County because the Ferrara Fire Apparatus is the only source of the vehicle which can both meet the required specifications developed by CDF and the La Honda Volunteer Fire Brigade and which can meet the time frame required by the grant agreement for purchase of the rescue vehicle; and

WHEREAS, an Agreement Between the County of San Mateo and the La Honda Fire Brigade, Inc. Regarding Purchase of Replacement Rescue Vehicle has been presented to this Board of Supervisors for its consideration and acceptance, and the Board has examined and desires to enter into the Agreement,

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that Board of Supervisors determines that the best interests of the County would be served without the necessity of further competitive bidding for the purchase of the rescue vehicle from the Ferrara Fire Apparatus, and any further competitive bid process conducted by County is hereby waived.

BE IT FURTHER RESOLVED that the purchasing agent is authorized to issue a purchase order for the rescue vehicle, that the County of San Mateo contribute $43,622 to the purchase of the vehicle, and that the County of San Mateo further advance the amount of $18,622 which represents a portion of the contribution to be paid by the La Honda Volunteer Fire Brigade to partially cover their funding commitment to the vehicle, which amount is to be paid to the County by La Honda Volunteer Fire Brigade according to the written agreement between the parties.

BE IT FURTHER RESOLVED that the President of the Board of Supervisors is hereby authorized to execute on behalf of the County the Agreement Between the County of San Mateo and the La Honda Fire Brigade, Inc. Regarding Purchase of Replacement Rescue Vehicle, and the Clerk of the Board shall attest the signature of the President thereto.
