SUBJECT:

Amendment One to the Agreement with the California Department of Aging for Title III/VII of the Older American’s Act of 1965 and the Community-Based Services Program for Fiscal Year 2009-10

 

RECOMMENDATION:

Adopt a Resolution authorizing the execution of Amendment One to Agreement AP-0910-08 with the California Department of Aging eliminating State funding for Community-Based Services Programs in the amount of $261,989 and increasing federal funding for the Ombudsman Program in the amount of $45,891, for a net decrease of $216,098. Effective September 30, 2009, the maximum obligation is thus decreased from $2,905,278 to $2,689,180 with no change to the term July 1, 2009 through June 30, 2010.

   

BACKGROUND:

Your Board has designated itself as the Area Agency on Aging (AAA) of San Mateo County to carry out State-funded programs pursuant to the Older Americans Act of 1965. On April 28, 2009, your Board approved the AAA 2009 – 2012 Area Plan for Services for Older Adults and Adults with Disabilities (Area Plan). This plan, together with the annual budget, fulfills California Department of Aging’s (CDA) requirements and generates a contract from the CDA for funding.

 

On April 19, 2009, your Board authorized Resolution 70110 approving Agreement AP-0910-08 with CDA for FY 2009-10 in the amount of $2,905,278. This Resolution also authorized the Chief of the Health System or designee to execute limited contract amendments.

 

DISCUSSION:

On July 28, 2009, the Amended 2009-10 State Budget Act eliminated Community-Based Services Programs (CBSP) funding effective September 30, 2009. This funding was allocated for Alzheimer’s Day Care Resource Centers, Brown Bag Program, the Linkages Program, and purchase of respite services. This Act reduced funding for these programs by approximately 75%.

 

The amended State budget also included one-time-only funding from the Federal Citations Penalty Account to local Ombudsman Programs increasing San Mateo County’s allocation for ombudsman services by $45,891. These changes in funding are reflected in this Amendment One to the Agreement with CDA.

 

County Counsel has reviewed and approved the Agreement and Resolution as to form.

 

The increase in federal funding from this Amendment contributes to the Shared Vision 2025 outcome of a Healthy Community by allowing Aging and Adult Services (AAS) to provide services to at-risk individuals that help them remain in the most independent setting possible, but at the same time the reduction in State funding decreased the number of at-risk individuals who received services in FY 2008-09. It is anticipated that 95% of at-risk individuals will be maintained in a least restrictive setting through case management.

FISCAL IMPACT:

The term of the Agreement remains July 1, 2009 through June 30, 2010. The maximum obligation for this Agreement is decreased by $261,989 in State funds and increased by $45,891 in federal funds, for a net decrease of $216,098 from $2,905,278 to a new maximum obligation of $2,689,180. AAS is analyzing the impact of this reduction and other increases in funding due to the federal stimulus to determine whether a mid-year Appropriation Transfer Request will be required in the FY 2009-10 budget. There is no impact on the Net County Cost as a result of this action.
