RESOLUTION 1) AUTHORIZING THE HUMAN RESOURCES DIRECTOR TO EXECUTE AN AGREEMENT WITH BENESYST TO ADMINISTER THE COUNTY’S FLEXIBLE SPENDING ACCOUNT AND CONSOLIDATED OMNIBUS BUDGET RECONCILIATION ACT (COBRA) PROGRAMS FOR COUNTY EMPLOYEES FOR THE PERIOD FROM JANUARY 1, 2010 THROUGH DECEMBER 31, 2013 IN AN AMOUNT NOT TO EXCEED $350,000; AND 2) AUTHORIZING THE HUMAN RESOURCES DIRECTOR OR THE DIRECTOR’S DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, an operational review of the Benefits Office in 2008 recommended that a third party administrator assume responsibility for COBRA administration to maximize efficiency of the Benefits Office and to ensure legal compliance with the ever-changing and complex COBRA rules; and

 

WHEREAS, prior to 2009, a Request for Proposals for a Flexible Spending Account (FSA) administrator had not been conducted in over six years; and

 

WHEREAS, in an effort to consolidate FSA and COBRA administration through a single third-party administrator, the County conducted a formal Request for Proposals (RFP) for these services; and

 

WHEREAS, as a result of the RFP, the Human Resources Department is recommending the selection of Benesyst as the County’s FSA and COBRA administrator because of, among other factors, its user-friendly online system, dedication to customer service, and highly polished communication materials;

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors hereby authorizes the Human Resources Director to execute an agreement with Benesyst to administer the County’s Flexible Spending Account and COBRA programs for County employees for the period from January 1, 2010 through December 31, 2013 in an amount not to exceed $350,000;

BE IT FURTHER RESOLVED that the Board of Supervisors hereby authorizes the Human Resources Director or the Director's designee to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
